Got our RFE today.... sigh

It's so annoying. They're basically asking for every single thing we submitted for the affidavit of support.

We submitted his last 3 tax transcripts, a letter from his employer etc... and now they're saying we are below the 125% poverty guideline which is $29k for us (he has 2 kids so that makes 4 person household) and he definitely makes over that....

So frustrating, annoying and aggravating!!!!

Anyone go through this?

And am I wrong? I'm looking at the pdf and it says $29,437

I don't know... maybe this is payback for everything else going smoothly..... arrrghhhh

Did they say what they calculated it as? Could just be a piece of evidence got lost in the paper shuffle dance.

No. They just said that I didn't submit anything with the affidavit of support.... So it's like they just threw it all away and said hey lets make their lives hell..... it also says they're postponing my ead because of it >< so not fun.

Also and I don't really know how I would document this to them..... but with the custody agreement with my hubby and his ex, he doesn't have to pay child support... so really it's only a 2 person household..... we pretty much just get the girls xmas, long weekends and summer because she moved 9 hours away with them..... don't know if that matters and like I said I have no idea how to tell them that

I reckon you should re-collect all your evidence, lots of pay stubs (include a few more than you did the first time, maybe, cover a whole year or so), the tax returns and W2s again and all that and then also include a cover letter with the maths referencing the evidence you're giving, so it's literally spelt out to them what the money you have is and where it's going and to who it covers.

Even with the deal with his ex, still just assume a family size of 4 since you can cover that and more anyhow!

How utterly frustrating for you! Much support from this corner.

First up, Lost at Sea has great suggestions.

A few ideas for you. Get copies of the tax transcripts ordered for the past three years, attach any W2 copies you have, pull together pay stubs for a period covering at least six months (and preferably over a year, I'd do one per quarter if you can). Photocopy everything if you haven't, so you can resubmit easily and you have a record of what you already sent in. If there is a special notation on custody and child support, you could go as far as printing the divorce decree (copy is sufficient, don't need notarised) which lays out the provisions as well. Take the requisite pages from the PDF and print them, then circle which table or category applies to you. Have the math outlined on a separate sheet. I endorse cover letters, too, as they're very helpful.

Do not staple, but definitely paperclip it all together, stick your A# on absolutely everything in the upper right corner (or where it'll not get in the way of visibility).

We had to send all that stuff in too and I guess we overwhelmed them (or they just approved us after our congressman stepped in). Very annoying!

So we are in the process of waiting for the transcripts (again)... redoing all the paystubs and banking info and letter from employer etc...

Fingers crossed.

OH ... the letter also said that they were putting a hold on working on my ead while they wait for me to resubmit.... is that normal? They didn't say anything about the advance parole, but I'm hoping that isn't included, because we're planning on going to Canada for vacation in August.... and I'm hoping that it comes in the next few weeks...

haha my hubby keeps teasing that he's going to write a complaint about the waste of paper the government uses... and the endless amount of trees we've killed with all this paperwork

Make sure you get the IRS tax transcripts. We didn't do that the first time and I'm pretty sure that is what triggered our RFE.

Yes it's normal to put a hold on your EAD/AP while you resubmit. EAD/AP is now a combo card so I'm pretty sure a hold on one is a hold on the other. My AP didn't get approved until after my RFE response.

The good news is usually your EAD/AP gets approved quite quickly after you send in your response (mine took about 2 weeks).
