Hello everyone !

I just arrived us today. I have son who live with my aunt in Vietnam. If I wanted to filling I-130 for him. What is proper step should I do?what kind documents need to accompany with the application. I did not receive my green card yet but I'm know they will send me soon. Can I send copy of biometric ?thank you so much

Anh Duy,

A copy o your biometrics is not proof of legal status in the US. You cannot use it in lieu of a green card.

You can send in a photocopy of your I-551 stamp on your immigration visa.

IMHO, you should wait to get your green card in the mail before you file.

My brother waited for his green card before filing for his children.

Beside green card, what kind of documents need to send in with the I-130 application ? I'm tried to get everything ready when I receive the green card . I will send my application right away.

Did you get your visa via the F3 category (Married Sons and Daughters of U.S. Citizens)??

If yes, your son qualifies as your derivative and can benefit from your approved F3 petition. Did you declare him as your child in your DS-230 form? Did you put his name on "the person who will follow you on a later date" question?

No my grandfather petition for my dad.I'm grandson trying to file for my son in Vietnam.

As soon as you receive your green card, you can file i-130. Include a copy of your son's birth certificate. Please be more careful with your advice.

The instructions for an LPR filing Form I-130 is that the person either includes a copy of the front and back of the green card or a copy o the biographical page of the passport and the I-551 stamp in the immigration visa (the one year temporary green card).

Don't just say an LPR does not need to privide a copy of a green card when filing an I-130.
