My wife and I are considering having her fill out the FAFSA form for student aid.

Can this negatively impact our quest for AOS? Would this make it appear that I am not financially capable of supporting her, according to our I-864?

This question may seem out there, lol, but I don't want to have any nasty surprises... yay for paranoia.

Since it is not listed on the I-864, it wont affect your affidavit, the only things listed on it are Income, and assets not debts.

Yes that is right comes under "Charge of the State" which is what the I-864 and I-134 are filed to guarantee that the alien immigrant wont become.

I am a bit lucky in this area, I work at a college, and my future wife could attend the college tuition free.

I am a bit lucky in this area, I work at a college, and my future wife could attend the college tuition free.

What? Then why did you tell the OP basically that he could file a FAFSA for his wife? She's not a permanent resident yet!

PS Are you really sure that student fin aid counts as becoming a charge of the state? I find that EXTREMELY hard to believe.

Here is a list of "non US Citizens" who may be eligible:

For financial aid purposes, an eligible noncitizen is one of the following:

A U.S. permanent resident who has an Alien Registration Receipt Card (I-551 or I-151)

A conditional permanent resident (I-551C)

A noncitizen with a Departure record (I-94) from the U.S. Immigration and Naturalization Service (INS) showing any one of the following designations: "Refugee," "Asylum Granted," "Indefinite Parole," "Humanitarian Parole," or " Cuban-Haitian Entrant

i don't know if it is considered a federal means tested benefit. Someone should check that out though, there is some conflicting information in the previous replies.

Ok, I looked it up - Student Finacial Aid falls under the list of EXCLUDED means tested benefits. I got this right from the USCIS site. So a PR can apply for and receive this benefit without the sponsor being held responsible.

Your wife should be able to apply for it, however she will need to fall into one of those non citizen categories in order to be eligible.

I should have researched this a bit further, the OP cannot file for FAFSA aid for his wife until after she become a Green-Card holder, only Citizens, and LPR's qualify for financial aid, so this wont affect the I-864 do to the fact that his wife dose not qualify and the FAFSA application will be rejected. Since the I-864 is filed befor financial aid can be applied for the financial aid wont affect the I-864.
Select "Eligible Noncitizen" if the student is not a U.S. citizen or U.S. national, and he or she is one of the following:

U.S. permanent resident, and the student has an Alien Registration Receipt Card (I-551)

Conditional permanent resident (I-551C)

Other eligible noncitizen with an Arrival-Departure Record (I-94) from the U.S. Immigration and Naturalization Service showing any one of the following designations: "Refugee," "Asylum Granted," "Indefinite Parole," "Humanitarian Parole," or "Cuban-Haitian Entrant"

The student can receive federal student aid if he or she is a U.S. citizen, an eligible noncitizen, or a U.S. national. If the student has changed from a noncitizen to a citizen, the student should contact the Social Security Administration (SSA) to update his or her citizenship status. Otherwise, the SSA may report to the Department of Education that the student is not a citizen, and the student will have to provide documentation to verify his or her citizenship before being eligible to receive aid. The student can call the Social Security Administration at 1-800-772-1213 or visit the Social Security Administration's Web site at www.ssa.gov to update his or her citizenship status.

If the student is an eligible noncitizen, the student must provide his or her Alien Registration Number (ARN) on the FAFSA.

As far as I see that is totally incorrect. Either she can apply for it or not. You need to retract that statement, rather than saying "it was kinda right".
