HELLO EVERYONE,

I HAVE A QUICK QUESTION. MY I-360 JUST GOT APPROVED LAST MONTH. I COULD WAIT FOR 3, 6, 9 MOS TO A YEAR TO GET AN INTERVIEW FOR THE GREEN CARD NO ONE KNOWS. I WAS WONDERING IF IT'S SAFE TO APPLY FOR ADVANCED PAROLE TO TRAVEL OUTSIDE THE COUNTRY? WOULD I HAVE ANY PROBLEM WHEN I COME BACK HERE?

If you were out of status for at least 180 days then you should not use Advance Parole, since you become inadmissible from the US.

Matters of Arrabally and Yerrabelly overturned this, but official guidance has yet to be issued by USCIS, so with at least 180 days of overstay AP might get you back in or it might not,

positivity 888 I always advise not to travel abroad with AOS pending not even with advance parole if you the alien was unlawfully in the US over 180 days .Here is what USCIS onbudsman says about it:

"Travel Warning Regarding Unlawful Presence

If you were unlawfully in the United States for certain periods of time and depart the country, you may not be able to return.

If you depart the United States after accruing certain periods of unlawful presence in the United States (time spent in the United States illegally) you may be barred from admission for either three years or ten years, depending on the amount of unlawful presence an individual has accrued. Any departure from the United States may trigger this ground of inadmissibility, even if you have obtained an advance parole document.

If you have accrued more than 180 days, but less than 1 year, of unlawful presence and who voluntarily depart the United States before the start of removal proceedings are inadmissible if you seek admission within 3 years of the date of their departure. If you have accrued 1 year or more of unlawful presence and you depart the United States, whether or not removal proceedings have started, you are inadmissible if you seek admission within 10 years of the date of departure.

I read about this before, I was tempted to apply for one but then somewhere in there I read that ap does not guarantee that the inspection officer must allow me to re enter the country, I will rather wait... Looking forward to Wednesday, my biometrics appointment :)

Then hopefully soon ead :)

My I-360 is not approved yet but I traveled outside of the country on AP in August and had no problems of coming back. I would not advice to travel though until I-360 gets approved as it's very risky. I was in this country always in status.

Sandraj, dunno what to believe anymore bc my lawyer told me there will not be an interview bc they asked all the questions on the I 485 form in January when I had my initial interview but there was no decision on that day..

Dont know how experience your attorney is but I know one thing is certain . Each and every one of us will have an interview. no iffs ands or buts about it.

My friend spoked to one of his cousin who filed for I 360 feew years ago , they got married and after two mounts she filed. She got her green card without an interview!

Somebody always know somebody who did something a certain way and got through. Regardless, you will be interviewed just like many others I know before me and those after me as well. Its no big deal really.Have a good day

HELLO everyone! I got my EAD card saturday and today I just left the SS office for my SS card. Does anyone know how long it takes to verify the DHS documents?! Because I heard once they verify them they issue u a number , and then u can go and have a print out of ur number,. I need it for FAFSA.

Any help would be appreciated. Hope everyone had a nice weekend :)

Ben B all Vawa filers filing AOS have interview, but if the alien has a green card and submit form I-751 waiver based in domestic violence then it's possible not to have interview. I had 3 cases (I-751 waivers)the aliens did not have interview, despite their case were based in extreme cruelty.
