Citragirl thank you for your response. I'm just confused because I received two letters for i360 one saying that I am approved n can file i485 with my local office. The second one says I got deferred action ad well and can apply for work permit i765 with Vermont office. So who do I file it with?

naptime when someone has a Vawa case approved with deferred action it means the alien cannot be deported during the time given by Uscis and the alien can obtain permission to work, and you do not necessarily have to rush to submit your AOS, because of that you can fill out thework permit using category "deferred action", but of course everyone wants to adjust status to get the Green card asap right? then ignore the deferred letter and submit I-485 based in your I-360 approval.

Considering you do not have a pending I-485 then fill out form I-485 and put I-360 approved (VAWA)and submit to Vermont. Submit form I-765 along with form I-485 and choose category ( C) (9). If you cannot afford to pay form I-485 then fill out form I-912 (fee waiver) ,submit form G325-A, I-864W and I-693 as well, copy of Vawa approval and documents showing bonafide marriage plus copy of your birth certificate and respective translation,copy of your passport(all pages)copy of your I-94(if you have one) copy of your marriage certificate, copy of your ex husband document,copy of divorce decree (if you have one) and copy of previous divorce decree(if you had one), 4 pictures passport style , copy of child's birth certificate(if you have one).

Thank you Sandra for your response! So basically both forms I485 and i765 have to submitted to Vermont office and I can file under approved I360 correct?

Would i765 will be approved (considering that I have everything in place) with in 3 months or it be longer?

I have another concern regarding J1 visa that I was on before the f-1 visa. I'm still trying to find documents to identify if I have two year restriction or not and I think I might. Would they approve my i765 while I'm waiting on "no objection" letter?

Also about the "good faith" in marriage, I was dumb and didn't make copies of things I sent w my i360. I still have pictures and marriage certificate and apartment lease we both signed and showing monthly checks w both of our last names. But all the bills n such I sent them w out keeping copies (dumb me). Do you know if they will kind of "merge" both files together since I did send affidavits from neighbors n such about our marriage or would I have to get new ones?

Basically saying will they use the previous evidence I've sent for i360 for the i485 I'm about to send?

Hi everybody,

Congratulations again to howtosurvive on your interview date.

I have very similar case with hers.

I applied for VAWA and I 485 together march 2013. Vawa is approved august :)) and September 7 th my I 485 is transferred to a local office. I have two issues that hopefully somebody will advice me with.

1. I am on F1 status, my I 20 was issued april 2012 and its valid till april 2014. I can keep going to classes, actually summer brake is over and classes starts late September. Should I keep going to school is my question? I have talked with my lawyer and I got a advice that its better if I stay in status. If I stop going to classes maybe the school will notify immigration that I have dropped the school and I will loose the status. Also if I am not approved for I 485 then I can get deported and if I keep the F1 status I can still stay.

2. I have marked on my I 9 form that I am a citizen. This is considered as a misrepresentation. What I should do? I wasnt sure if I have marked that until 2 months ago when I asked the manager to check for me. I personally dont think its a bad thing because my intention was to survive and to pay taxes. It will be a different situation if I have claim that I m a citizen if for example I applied for a loan.

Now I am freaking out, is there anybody who has been in my situation and what should I expect at the interview? How should I get prepared? Will they already know that I have claimed citizenship at the I 9 form? Please any thoughts?

I am a little confused too, so are we supposed to receive our ead before the biometrics are taken?

IM IN THE SAME BOAT! i got my APPROVAL for my EAD today thanks to SANDRA! (sent i765 and i485 on august 14 and today september 6 got approved for EAD)

But i got biometrics appointment for i485 ..... im confused... idk if thats normal soo...

do i have to wait after my biometrics to get my CARD or ... ehhh so confused. im just glad it got approve! GOOD LUCK! stay positive!

I know what u mean I thought I had to wait for my fingerprints to be taken before they approve my EAD .. But my appointment for my fingerprints is the 19 of this month.. and on my case status it says : they approved my i765 and my card has been produced and I should get it in 30 days.

Cielo I do have a current passport I got it before I separated I needed id to rent apartment. I also have a document that the Mexican consulate issues, matricula consular.

Naptime if you have the 2 years restriction you must file an waiver asap to overcome the restriction otherwise you can't have your GC approved but they will approve your EAD without any problem.They have your Vawa file.It's advised to submit all proof again but they have your Vawa file there.
