ukboy you can't keep a green card and have an H1b visa, you have to decide or you keep your H1b visa ad forget about it the I-360 and bring her with H4 visa, or file form I-485 based in I-360 but then she has to wait a few years in UK. Regarding bring her with any I-485 approved it will take years.

You can't bring her with H4 visa and apply for AOS based in your I-360 because once approved your AOS her H4 will not be valid anymore and she will be here without status.

ukboy you posted one question i answered according with your post now you gave different information then the answer is not the same.If you did not file AOS yet then you can include her in your AOS petition and once approved your AOS you can bring her filling I-824 and your wife may be eligible for following-to-join benefits. You have to get married before submitting your AOS.

Hello and congrats on all recent approvals :)

I have couple of questions, my I-360 was approved with deferred action. I did not file for work permit or I-485 with my I-360. Now I'm almost done getting everything together but I'm concerned that I might be filing under wrong category.

1.For my I-485 application that I'm filling with my local USCIS office do I put based on approved VAWA or based on deferred action status?

2. For my I-765 application that I have to file with Vermont office I have to file as deferred action correct?

3. If I have to file I-765 as deferred action do I need to submit the I-765 worksheet to show economic necessity as it states in the I-765 filling instructions?

Thank you very much!

I had my EAD approved in 3 weeks at the beginning of August and my appointment for biometrics was two weeks later. Biometrics appointment has nothing to do with EAD.

Hi lank,

How did you check for card production?

When I log in to check my status, I only see the VAWA approval message. Am I supposed to click another page to know if my EAD has been approved?

Thank you

I applied about 7 weeks ago.

bambi5 if you already received a receipt for your employment authorization, put that number in the status on uscis.com page and it will show you the status.

Thank you so much dear lank for responding so quickly.

My receipts went to my lawyer. I will actually email her now to check on the receipt number.

Thank you again

This will require Sandra's advice but I can tell you that you don't mail the applications to separate offices you send all the package to Vermont and on the right side of the envelope you write VAWA unit on big bold letters.

The form asking for waiver goes on top of everything because they check for payment of fees
