jessyL the individual can file Vawa just based in financial abuse, and some of them had their Vawa approved. I had one case the abuser forced the victim to sell the only property she had in her home Country, he took ALL money from her and he used her credit card leaving her with a debit of $40k. Vawa Unit approved her case based in financial abuse, but she proved that she transferred all money to his bank account and he used every single penny in less than 5 months buying frivolous things.

Forbidding the victim to open or maintain personal bank account is not considered financial abuse since the "victim" can open and/or maintain a personal bank account without the abuser acknowledge. In the United States banks CANNOT disclose to a third part if you have a bank account or not. Banks can disclose information about your account just if the third part is the IRS or an individual with judicial order.

Hi Everyone,

This is an interesting topic going on. I think i can relate to what she is mentioning and I would like to explain in detail though my case had abuse at all levels but just for financial clarification.

My husband was controlling all my finances. He forced me to open a new bank account and add him as a joint account holder and made me transfer all my salary there. Technically, this is not abuse as per VAWA because I can anytime open a new bank account n get my salary transfer there but this situation is not black and white. I was in abusive situation and was so scared of my ex that I didn't have courage to do anything that would make him mad. So now how would it help me even if I open a new account and Bank doesn't disclose that info to my husband because practically I still cannot transfer salary to my separate account. So, I think that is what she is trying to say that her husband didn't let her maintain separate account and even if she had done that, it was no good to her because having a separate account doesn't help, what she needs is separate finances.

Hello everyone,

It's almost a year since my i485 interview on approved vawa. Still no decision. Last week I got an email and it says my case is transferred to another office.

Does anybody have an idea what that means?

Well i am shocked to death!!!!!! are you serios??? I thought it typically happens in the interview the approval or the least 2 weeks after..Wow!!!!

I am too I never knew a decision could take that long.....My journey did you have your lawyer enquire or did you try calling? But isnt it a done deal once the I-360 is approved?

Dont know about being a done deal after approved vawa but I never heard of this almost a year wait after 1485 interview..Never!!!!

Usually the local offices set up interview after 2/5months they received the case,it depends on workload.I would say to wait at least 4 months and no more than 6 months to inquire about the AOS.

Sandra I would also like to know when they transfer your file to the local office would I be able to check that status on the USCIS website too using the receipt number.

Then anyday now for me, maybe in a week or so.. if it falles in the category of 2 months

Hi all,

it's been a while since i posted here but I hope you all are finding strength to keep up with the stressful situations that led us here and the lengthy process that comes with it.

as for myself, i am so tired. at times i wish God would give his hand and take me with him in the smoothest way, after i say good bye to my loved ones. but as a child of God i can't do that to myself.

I'm really sorry if i sound too depressive right now, but i'm just letting out some of the stress i have accumulated recently and wish to find in others who like me are going or have gone through this, the words to appease my spirit and mind.

it's been about 14 months since i applied and yet it is just now that they think they can issue an rfe. is this something usual? what could they possibly want again that i have not submitted?

i hate to think back about what my marriage was and i try to forget the past but they just hit me yesterday. i hate myself more thinking about her.

Please may someone hit me with the power of words because i really need that right now.

i belive anything happens for a reason but i wish this was much easier. God, forgive me.

hi guys,

help me out here, i got rfe and there are asking for my spouse birth certificate and a disposition from the court,(my case was dismissed), l gave them all the documents already, now my lawyer said she emailed them, and is hoping for a response in a few days. Are there any other disposition other than the one the courts give me(notorized and signed). this is crazy anyone gone thru this before.
