Panama guy it's up to you hiring a lawyer but your lawyer won't be able to do anything besides inquiring Vawa unit and your former lawyer,you and the congress person inquired already.You will just spend money for no reason.They won't give any information different just because you hired a lawyer.If you really want to make noise then file a writ of mandamus well they will adjudicate your case before you finish subpoena all agencies.The writ of mandamus is to force Uscis to adjudicate a case that is out of processing time. Don't worry they won't retaliate because you are doing that.You need a lawyer it's a very complex process but every time i filed the mandamus in 48hours they adjudicated the case because they won't to spend money with a law suit against them.

Panama guy before filing the writ of mandamus to prompt them to adjudicate your case ask your lawyer to draft the writ of mandamus and send a copy to Uscis with a letter ecplaining if in 30 days your case is not adjudicated further action will be taken.The U.S attorney doesn't want to waste his time in Federal Court explaining Uscis delay in adjudicating a specific case. Most of the time they hurry to act when they know a writ of mandamus will be filed in Court.Talk your lawyer about it. IF he says they can retaliate you then do not walk run because he is a ####### lawyer.I filed several writ of mandamus and without any problem and many of them i just threatened to file the mandamus and they adjudicated the case.I am using my phone sorry for mispelled words.

Jessy L I don't know who is your psychologist but I read hundreds of psychological evaluations and many of the evaluations stated that who participated through coercion and/or threat in unwanted sexual activity which the person finds disgusting is considered victim of sexual abuse . Your psychologist is talking about rape, sexual abuse is NOT JUST RAPE for God sake.There are 3 types of sexual abuse : verbal, visual and physical.

Vawa Unit considers sexual abuse:

-Not allowing you to take birth control pill;

-demanding sex using threat of making public photos e films the abuser videotaped ( my Vawa case approved last week );

-fondling you in public places, in front of your family and friends;

- using threat or coercion to make you watch pornographic films when you don't want to watch;(one of my Vawa approved)

- prohibiting you to breast feed, through threat or coercion;

- demanding you to have a breast argumentation, using threat or coercion;

-demanding you to have sex with others using coercion and/or threat(base of one of my Vawa and it was approved);

-threatening someone into unwanted sexual activity;

ETC.

The lawyer is no good either. She keeps on telling for any question I have "not my expertise" and would not even advice on how to write the testimonial. Or even read any letters from witnesses ((

What do I pay such a big money for? So she just fill in the I360?

Guys (and mainly Sandra),

During the aos (for I-130) interview (with lawyer), when the husband did not show up. USCIS officer gave 30 days to hold I-485 (deadline on 24th of July),

he said that we need to file I-360 and send the evidence that I-360 was filed to the local office.

Lawyer wants to file all case (because wants to be paid in full). She also said that we need to file the receipt. But as I know there is no way we going to get receipt (NOA?) so soon.

So questions:

1)what can be the evidence that I360 filed?

2) can we file the I360 with minimum documents for abuse (just letter from shelter). And mail to VAWA unit psychological evaluation and witnesses letters together with own testimonial a bit later (2 weeks later) without waiting for the RFE?

Jessy L you must submit everything you can right now and just the psychological evaluation and affidavits from friends And you can submit later on i mean they could write the affidavit in 10min no? .Your affidavit must include the whole story since you met him,courtship,marriage,Abuse and separation.You must tell in details every single abuse mentioning date,what he said or did and how you felt.Tell them who you were before the abuse and who you became after the abuse..Mention details if he used of humiliation,degradation,coercion,isolation etc.. Send copy of his passport or birth certificate if he is american,copy of your marriage certificate and copy of your birth certificate as well with respective translation and prove of bonafide marriage.You wont be able to get any receipt before 25 days.YOur lawyer can submit to the local office proof that she emailed your I-360 and when you get the prima facie then you submit copy of the prima facie. If you do not feel confortable with your lawyer find another one.

They can wrote already. Problem is that lawyer hold on to them already 2 weeks, as if she is "reading them", and than it will take time to notarize them ((

Today, i went to the infopass office.Be honest, not helpful at all. I just want to know where is my I-485 document right now. Because i made a requirement about holding my all of I-485 files in the local office until my i-360 approved when i had an interview last year.

now my I-360 has been approved, then i went to the local office asked them if they are still holding my files, the officer told me they lose it. she wants me contact with Vermont center get more information.

I feel so frustrated, how come she told me they lose my files. i dont know what is going on for the next if Local office lose my files.

i sent an email to Vermont center after i was back from infopass office, i am hoping they can give me some useful information about my I-485.

I dont think the inforpass officer knowledgeable too much I-360, i told her i-360 case number isnt my i-485 case number. i gave her my i-485 number but she didnt want to check at all.

just gave me an email address of Vermont center, let me to go ask them.

right now i am super worried about my i-485 document. where they are?

Hello everyone.

I been off the forum for a while. Just want to drop by and say hi to everyone . My case still the same almost 20 months and nothing.

I just called the customer service to see if they can give me an update on my change of address that was sent a request in writing ,notorized and certified mail requesting to change the address and remove my attorney from file because i no longer have her representing me. But nothing no answer and the custumer service laid said that she cant do anything for me because no case comes up with my receipt number. I also sent them a letter 3 weeks asking to renew my prima facie and asking them to please adjucate my case because i need it badly. And no answer neather, i ask for help from Ombudsman's office more than a month ago and they said that they enquired on my case and will let me know when they receive a response,but no answer ...... Now my prima facie is EXPIRED and i cant get a response from VERMONT , i already asked for help in the last 7 months from 2 senators, 2 congress representative and my attorney also called when she was still on my case ,and they all come with the same answer USCIS TOLD ME THAT YOUR CASE IS BEEN ADJUCATED BY AN OFFICE AT THIS MOMENT AND THEY SHOULD MAKE A DECISON VERY SOON. That was 7 months ago. And my case dont show up online neither , when i input my case number at the uscis website case status it come back saying YOUR CASE CANNOT BE FOUJD AT THIS TIME. Anyone have any sujestion?

Sandra. What do you think? Keep waiting or its time to make some noice. The problem that i am so weak that i dont even have the strech to make any noise PLEASE HELP with any sugestion that could help me.

"case not found " is a good sign. They are actually working on your case and you should get an update really soon !

I will say a patient spirit is the virtue of a gentlemen, VAWA law is original for feminist, men are just the decoration on this cake, you should check VAWA part2, two guys got approved after they waited 34 months and 6 years. Basically even you make noise, you still take whatever they give you, the fact is that they dislike to be pushed to work, we should avoid to keep them nervous. In the event, your strategy works, but that chance is still 50/50 percent, Whatif it doesnot work, people still need refile by collecting more evidences or appeal, that will be another long wait. so why bother it, just let it be, live your life and pursue your happiness.

Another thing is hiring attorney, one California attorney told me he always lose his Vawa cases for men, so my point is if I were you, I would not push that red button by filing a writ of mandamus. you will get approved soon, May God be with you and all vawa prayers!

I have to ask something here please do not contact me to help if you are concern about your abuser reputation.I receive hundreds of emails per month and those women and men are willing to do what it takes to get out of the abusive relationship including filing police report and restraining order against the abuser. I get upset after reading emails with 5,6pages and the person asks me " i dont want to do anything against him because he my lose his job" or " I dont want they arrest him",well I am an advocate for victims of domestic violence i don't give a damn about the abuser reputation or if he will lose his job etc...It's not your fault the abuse inflicted upon you, but it's your responsability to remove yourself from a poison relationship and keep you and your children safe.I am not willing to help anyone who is concern about the well being of their abusers...hell no! Abusers are the scum of our society.

younge seattle with all respect where did you get this information that if someone files a writ of mandamus the person is pushing the red bottom?How many people do you know that filed writ of mandamus and they were denied just because they filed the mandamus? I assure you i filed many, but MANY writ of mandamus and I did not have a single problem with that. The writ of mandamus exists for a purpose and thousands of mandamus were filed in the last 10 years for several attorneys without any problem, please do not disseminate information that you do not have legal acknowledge.
