As I said above, if you were married to a US citizen and obtained a green card through VAWA then you can apply after three years; if you were married to an LPR and obtained a green card through VAWA then you must wait five years. This is precisely what that memo states.

I believe it depends on whether you are claiming VAWA based on marriage to either a US citizen or an LPR. If US citizen then, provided you filed an I-485 and I-765 with your I-360, then it should be approved within a few weeks of applying. I don't believe VAWA through marriage to an LPR permits you to file an I-765, but I recall Sandra stating that she knew of some people who were still able to obtain an EAD in this circumstance. She would likely be able to give more information about that.

cielo14 we have here in the visa journey some people married to an LPR and they got work permit. The work permit may take a few weeks to be approved (2/3weeks).

The Uscis memorandum states what hypnos explained very well.

Hope all is well and that you all getting ready for the 4th of July and some nice fireworks :)

I finally got my letter from Vermont office telling me that I can start filing my AOS with my local office. While I was looking at the form I saw this question and it kind of scared me, something I definitely spaced out " Have you ever been a J non-immigrant exchange visitor who was subjected to the 2-year foreign residency requirement and have not yet complied with that requirement?"

I came to US with J-1 visa as exchange student in June of 2006, I went back home after my school year was over and was able to get F-1 visa months later to come back for college, so I never met that 2 years of foreign residency. Now my I-360 is approved and I'm trying to file for AOS. I can't go back home for 2 years. How common is this? Will they deny my AOS?

Please help :/

How long did it take you to get the letter after your I-360 approval?

Also, you didn't file I-485 before, right?

naptime were you subjected the two-year home residency requirement 212(e)? it's written in the visa and/or DS-2019 if you were subjected to this requirement you must have the tow year requirement waived otherwise you can't receive your green card.One of the girl from this thread just submitted her waiver in order to attend the interview.

If you subjected to the two year rule and you did not stay in your home Country the time required then in order to stay here you must request a "letter of no objection" from your home Country's Embassy in Washington, DC and then you have to apply for a waiver of the two-year home residency requirement.
