Here is a list of documents that you should submit showing that you were victim of domestic violence and that your marriage was in good faith.
Letter of the shelter
Therapist or Psychologist letter mentioning the abuse you suffered
Pictures of the abuse suffered, if you have
Past or present court orders that prohibit your spouse from approaching you
Hospital or clinic reports that show that you were physically assaulted
Have attended a support group for survivors?
Notarized affidavit from people who know you and your spouse and who can affirm that your marriage was a bona fide marriage
ceremony or who knew you as a married couple. These letters should include as many details
as possible.
A personal declaration in which you describe, in GREAT DETAIL, how you met your spouse,why you got married, describe the when started the violence WITH DETAILS
Wedding pictures
Letters or statements from a bank that show that you had or have a savings or checking account together
A rental agreement for your house or apartment with both of your names on it
Utilities bills such as electricity, water, heat, cable TV, phone, or others that show both you and your spouse’s names.
with both of your names on it and/or bills in your name
Income tax papers that show your name and your spouse’s name
Life insurance policy
Medical insurance
Pension/retirement
Membership cards for video clubs, grocery stores or similar businesses, that show joint membership for your and your spouse.

Okay so I'll get all this list and put it in an envelope with

I-360 Petiton for Amerasian, Widow(er), or Special Immigrant, I-765 Employment Authorization Document, I-192 Request fee waiver

I will send it to

Vermont Center 75 Lower Weldon St. Albans, VT 05479-0001

Then all being well I could get an EAD within say 3 months?

I'm just trying to get everything together so I don't forget anything.

Then after that I can proceed with AOS?

With the psychologists report it will take about a month or 2 months to get that along with Moral character, You need to do back ground check in each State you lived more than 6 months. So you are looking at 3 or 4 months maybe. Some folks get work permit sooner than others.

yes fingerprinted and all that good stuff. Costs about 50$ or more. This is a process not automatic. Your documents have to be together and in order or else denial.. is your wife American Citizen?

oops, try to google ( how do i get a background check or fingerprints done in your state for uscis) I went online , filled out a form ,paid and was able to go to the state office in my town and get it done.

You cannot obtain an EAD (through an I-765) with only a pending VAWA, only with a pending I-485 or an already-approved VAWA I-360.

It's currently taking around a year to process VAWA I-360s, and only approved VAWA I-360s can obtain an EAD if you don't also file an I-485. To put it another way: a pending I-360 is not entitled to an EAD, but a pending I-485 is.

You said above you were hopeful of getting an EAD within three months, and that's probably not going to be the case.

It's currently taking around a year to process VAWA I-360s, and only approved VAWA I-360s can obtain an EAD if you don't also file an I-485. To put it another way: a pending I-360 is not entitled to an EAD, but a pending I-485 is.

If I send in the form I-485 Application to Register Permanent Residence or Adjust Status do I have to send anything else apart from a fee waiver. I believe this form as to do with taking a medical.

The reason why I ask is because I took the medical when I first came and that cost me over $600, I don't have $600.

If I can fill in the form I-485 on its own and send it with the other forms and information they need, that would get me EAD faster?

The idea is that that gaining the EAD will be a great, so at the moment that is the main objective, spending time and money gaining a green card will come afterwards, already I have to find $50, money to print out all the forms, postage, any travel expenses.

John F, this VAWA process will be long and sometimes tiring journey for you.

You have many documents to gather before you could even start filing the I-360, let alone getting a EAD to start working asap.

You would want to put together a solid VAWA case for your filing.

Have you get your psychological evaluation done yet, like what sandranj has told you?

This guide is written in 2008 but could be still relevant to you.

There is nothing you can do to speed up nothing. If you file all the paperwork together which is i360 i765 and i485 then you stand a chance of getting EAd with pending AOS (since your wife is US citizen) .There is no automatic approval.All the documents you need to even file i360 takes a while, then you have to wait for acceptance and receipts , then you have to be fingerprinted for I765 then you wait agin 6 weeks there abouts.. So first thing first gather all that you need, start getting affidavits, go to a psychologist and all these things, get the police report if you have one from the police station.Its not easy but you have to begin.Rushing to do things will create mess

If you also filed an I-485 then yes, you would need to include all of that form's supporting documentation, including the I-693 medical exam will which likely cost a few hundred dollars as you stated.

Additionally, filing an I-485 concurrently with a VAWA I-360 carries additional risks. If USCIS deny your I-360 then they will not usually ask ICE to initiate removal proceedings, but if they deny an I-485, they do. You therefore run the risk that, if you concurrently file a VAWA I-360 and an I-485 which are then denied, you will probably find yourself in immigration court with ICE attempting to deport you.

So right now there are only two ways you can obtain an EAD: (i) wait for your I-360 to be approved (this will take about a year) and then apply for an EAD based upon any deferred action USCIS give you as part of the approval, or (ii) file an I-485 either concurrently with your I-360 or after its approval. You can then file an I-765 based on the I-485 and will receive an EAD usually within three months.

I693 can be submitted later. I say this because I just did mine and is taking it to my interview as they requested in official letter from uscis
