piper2013 many cases are transferred straight from Vermont to the local office when the Vawa unit adjudicator believes the file is complete, but if in the local office the adjudicator notices something is missing he/she will ship to the NBC to issue a request of evidence (RFE). I just wanna be amongst those people that gets a GC without RFE. I'm putting together my docs and by 1st week of january I should be submitting my AOS. Sandra I will make sure you confirm I got everything is complete before I mail them out.

Enjoy your vacation Sandra. :) . God bless

I see, sandranj, thanks for that. That means that I - and other people here who had their files transferred first to Local, then to NBC - should be receiving RFEs. But shouldn't we have already received the RFEs? I mean, my case has been at the NBC almost 2 months now (the online system shows that the last time it was updated was 1.5 months ago). Would't they have sent the RFE then? Other VJ members' cases have been there longer than 3 months and these people haven't received any RFEs either.

Here is a question. If I went to an Infopass appointment at the local office, would they be able to tell me what the reasons were for my case to be sent to the NBC (i.e., what is missing from my file)? From what people around the forum are saying, it sounds like doing an Infopass might be pointless. But if they can tell me why they sent the file to the NBC, then it might be well worth it.

I think I have an idea about what was missing from my file: my fingerprints.

I filed my I-485 in the middle of October. Vermont received it and mailed me a Notice of Receipt 1 week later. Then the online system said the file had been transferred to the Local Office. One week after that, I received my fingerprints appointment. One week after that, I received a letter saying the file had been transferred to the NBC.

Because I have received no RFEs, it is possible that the following happened: If Vermont first sent the file to the Local Office, at the Local Office they saw that my fingerprints were missing. That raises the question why Vermont would have sent my file directly to the Local Office - can an adjudicator really think that a file is ready for an interview if the fingerprints are missing? Anyway, I did my fingerprints only AFTER the online system ever said that my file had been transferred to the local office.

According to the Q&A NBC-AILA session in May, the NBC is supposed to make sure that 4 things are in the file before the file is sent to the field for interviewing: 1. Valid fingerprints; 2. I-693 Medical; 3. I-864 Waiver of the Affidavit of Support; 4. Birth Certificate of the Applicant.

The fingerprints were definitely missing from my file at the time my file was ultimately transferred to the NBC...

Are there any other people here who did their fingerprints AFTER the file was transferred first to Local and then to the NBC? Ben B, Fancy 1, anyone else?

Hi,

I am in the same situation. Some of you already know since I have contacted you through personal email. But for the ones that dont know, my I 485 was transferred to NBC in October.

I found it pointless to make infopass or e request so I ll wait for a month or two. Please anybody who will find more info about this issue to inform here.

It looks its like 5-6 persons that have been vawa approved around august this year and all our file is at NBC.

piper123 keep in mind that NBC does not issue just RFE, they do a background check as well,in your case if your background check was not completed they might sent back to finalize the background check .If your case is just regarding background check you won't get RFE.

Some people get RFe after 4/5months in the NBC.Infopass will not tell you why NBC is holding your case.

fajrakatana it might be many things such as requesting additional information such as additional evidence, missing documents, or they couldn't issue the visa because is pending security checks.

Did your children attend an interview? If yes they sent it back to the DOS (Department of State) to review the case, then DOS sent it to USCIS for further review (to revoke or to reaffirm the case).

fajrakatama probably his case is with the District office, his case is not with Vermont. If your ex husband is a green card holder probably you don't have a visa number available and consequently your son. It might be so many things and I don't like to speculate, the best thing to do is to set up an appointment with infopass.
