Ok, what proof did you have for abuse?

Marriage Certificate, her citizenship copy, lease agreement, joint account, insurance, phone bills, doing therapy with Psychologist right now, police clearance reporting on the way. will prepare family, friends maybe landlord affidavit. No police report, no restrain order. trying to file Vawa basd on mental abuse

Usually when filing, ALL documents are submitted at once. If its not sufficient then an RFE is sent to you from USCIS ( request for evidence).I do not suggest you send anything until they send an RFE ( I hope and pray they do) . Lets see what others think.

thanks, but I guess I need to send in I485 and I768 for EAD anyways, and asked them to join to my existing I360. Maybe send all the rest of the documents together with them?

Lets see what Hypnos and Sandranj says first. Good thing is you got Prima Facie. They will respond

BelieveinVawa what a mess huh? Maximum in 40 days you will receive a Notice to Appear in Court for your removal, then you MUST go to the Court to tell the Judge you have a pending Vawa, and he will not remove you until you have your Vawa decision. Since he did not put a hold in your case then submit form I-485 and I-765 ASAP, you can ask to waive the USCIS fees. Filing form I-485, you must explain in a separate sheet about the denial, but mention you are not in removal, otherwise they will not accept your new form I-485.

Why did you submit form I-360 without a psychological evaluation? The evaluation should have at least 10 pages.Tell your psychologist to mention:

Presenting problems

Onset of problems

History of the relationship

History of the mental abuse

Tests applied (at least BDI,GAD,BAI)

Treatment plan

Diagnostic formulation

Conclusion

Number of sessions.

I already showed the IO my I360 Prima facie, IO also said Vermont Office will ask the local office send all my I130, I485 document over. And I remember they mention about not put me on removel. Are you sure I will still receive and appear in Court Notice? Also they did not take my EAD back, and they indicate that if the employer did not check the ead again, I can still work while applying for the new EAD.

and I am working right now and I do have income, will this make me ineligible for I485 and I768 fee waiver?

When I submit my I-360, I have not seen the Psychologist, and I attached a sheet saying that I have a pending I130 and I485( at time I filed I360) also I said I will send in Psychological evaluation and Police clearance report once I got them. I guess this is why they issued me prima facie 2 weeks after filing

i waited 3 months plus ,near 4 ,it just transfer.interview date pending. i should get letter in 30 days email said

Hunni.March is 3 months away. Focus on that Mid January.I ddnt pay anything to renew and I don't think you would either. I got it in 3 weeks if so long.Dont worry

You have to refile with i765 form as a renewal.With copies of the old Ead and the letter it came with.
