hi guys, got my E AD approved yesterday, ya!!! GOD IS AWESOME, 88days.

congratulation me too i got my EAD approved yesterday after 115 days thanks GOD and good luck for the people whose still waitiing

Hi everyone. Hope all is well. I've been just reading the forum since there was too much tension going on. Anyway.

My petition is denied. I just got a notification this morning that they sent me final denial decision and will receive it within 15days. Im not sure the reason til i get the letter. Ive got RFE for prof of my husband's citizenship and requested them to look for it their own cuz there was no way i can collect the doc they wanted. Maybe that's the reason of denial. I dont know what to do now.

Its so depressing.

Wish i would have happy holidays.. Oh well...

Kittykitty is your husband a USC, I follow this thread but I do not ever comment because I work with victims of DV but I am a male, and this thread can get pretty tough on men so I kind of stay out of it. That being said I do not know your case if he is a USC where is her from? Did you submit a copy of your marriage certificate? if you FILE and FIOA request you can ask for a copy of your file from USCIS and there will be a copy of his passport in the file (or should be), however this takes about 90 days. Did you answer the RFE?

The Burden of Proof was on you and you for some reason believed that USCIS needed the Proof of your spouse citizenship and as a result THEY (USCIS) should get it. You may have to appeal this decision which buys you time.Or refile. Nevertheless, as a petition in any matter, be it in lawsuit or whatever it is, please remember THE BURDEN OF PROOF IS ON YOU

kittykitty1234 if the only reason of denial is because you did not submit copy of his birth certificate or copy of his passport then your lawyer should right away to ask reconsideration OF the decision of your vawa denial, and in the letter your lawyer should ask THE REQUEST SHOULD BE REVIEWED BY A VAWA UNIT SUPERVISOR. There is a memorandum from USCIS stating if the alien does not have proof of the status of the spouse, the alien can ask USCIS to search about the status of the alien's spouse.

I worked without EAD for 1 year after my I-485 was denied with my abuser and after I applied for VAWA , paid taxes and answered the question of where I work in the application that I am working and previously worked for AOS.Will my green card be denied?what if I asked about that in the interview?are there any other reasons the officer can deny my green card application in the interview so I can prepare myself?

Happy thanksgiving everyone!

Unfortunately I have yet to receive any notice from immigration even though I sent my case in back in August of 2012, and responded to their RFE in October. I contacted my local congressman and he checked for me and they stated they do not have my A file and will not process my case until they have them. Sigh, I just want this phase of my life over I don't want to keep thinking about immigration or remembering I was married to that jerk. :/
