Cielo if your priority date is not current then you can't submit form 485,you just can submit form 765 if your vawa was approved.We have here in the thread some spouses of green card holder and they got EAD despite the priority date wasn't current,but there is no provision in the law for that,and as far I remember you submitted already and they did not issued you the work permit.If your Vawa was approved then you willingly EAD based in category 14 or 31,it depends if received deferred action.

Just checked the uscis website and saw that they approved my vawa application. Yeeeeesssssss, thank you so much sandra. i cannot say thank you enough.my journey is not finished yet but i learned a lot. Filed my vawa last aug 1 2013. My husband abuser is usc. Got rfe last sept. Just saw approval today. Thank you lord

thank you so much for your informative answer.I was misinformed with my previous lawyer about a lot of topics you cleared for me.I want to ask what is meant by deferred action which came in my VAWA approval?does it mean i was illegal all this time although I received old EAD and SSN?I used my ssn to work?was that illegal?

plz sandra help me it been 98 days and my EAD (renewal) still in initiat review i dont understand why take so long i have approved vawa and DACA i call last week and i did request in she said 5 days and i will get answer but still nothing and i call the uscis officer but he refuse the discute with by the phone because it vawa case i dont know what i have to do the landlord he give the chance until end the mounth to pay my rent but how i can do and i cannt get job without my EAD PLZZZZZZZZZZZZ any advice

Optmisticchic yes you have to change your address with vawa unit, it must be a notarized letter ok

Pure deferred action means they cannot deport you until the date they specified in your Vawa letter, because of that the alien has to submit I-485 and have the case adjudicated by USCIS during the deferred action period.

Once you have filed Vawa you just could work with a valid work permit, if you worked using an expired work permit and USCIS finds out oh men you will be in deep trouble.

Jessy_L if the alien filed I-360 and I-485 and the case was denied the alien will be placed in removal proceedings,and if the alien was without of status he/she will have a ban to reenter in the U.S. (3 and 10 year bars), the 10 year bar applies if the alien departs after being unlawfully present for 1 consecutive year or more.

In case the alien gets married to a US Citizen then she/.he has to apply for a waiver of inadmissibility (I-601)to overcome the unlawful presence , and waiver I-212 to overcome the removal from the U.S, but it will be impossible to get a work visa,student or tourist because because the alien has to ​wait for the ban to be lifted.

yes i did c9 an submit i485 with i360 and my sepouse us citizen

Rohy submit an e-request and contact the Uscis ombudsman and your congress person as well.You filed using category © (9)and your spouse is a USC then you should not wait that long.

i am in great greatttttttt trouble..because to get waiver from fees of GC,work permit,i submitted my tax return which shows that I worked last year.How can i fix that?I had old i-485 and old i-765 which were denied in feb 2012 and my vawa was received by USCIS in the same month so I thought I could work with my old work permit till they make a decision

Pure you can't change anymore.Working without work permit after filing vawa is ver serious.
