Something like 99% of appeals are denied, which is something to bear in mind.

You should consult with an experienced immigration attorney, and perhaps begin to make preparations to leave the US in the absence of any other route to legal permanent residency.

They will only initiate removal proceedings against you if you also filed an I-485 along with your I-360.

Then yes, I'm afraid they will likely initiate removal proceedings against you. You should speak to a immigration attorney to explore any options you have.

yah i filed my i485 along with my i360 last oct 2012 as advise by my lawyer, then it was also denied yesterday. so they will send me a letter/mail for deportation also?

Did they informed you about the reason to deny?

But don't panic. Its not like they'll knock your door the next morning and take you away.

You'll get NOID first > reply to that if possible > then u might get NTA > You'll get some date in next few months to appear before judge > then judge will make decision about yr deportation.

SandraNJ/Hypnos: please correct me where I am wrong :-)

May be other members who experienced VAWA denials by themselves or from other members can help you with next steps.

Usually its refile or appeal is the option?

you should file appeal to that decision quickly.Plz change ur lawyer.Vawa success rate is over 70%.This time collect enough documents for the last RFE.I assume they did not have enough evidence for the last RFE they sent you.You can make it this time

I got this quote of law from a friend regarding help from government to battered victims like my self

"The Notice of Approval or the Notice of Prima Facie Determination may be presented to benefits granting agencies as evidence of status as a "qualified alien." Benefits granting agencies may verify this using procedures outlined in the"Interim Guidance on Verification of Citizenship, Qualified Alien Status and Eligibility Under Title VI of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996," AG Order No. 2129-97, 62 Fed. Reg. 61366 (November 17, 1997)."

so do you know what are this granting agents?are they special units in DHS or what?they told me in the special unit that if I am asylee or refugee they would help me.So is VAWA considered asylum or refugee?

Dovey, so sorry your application got denied, what was the rfe about, maybe your statement was weak, by that I meant that you might not express in writing form what you went thru and elaborate in extreme detail about the abuse. Did you explained about ALL the response that you submitted... For what I have read here, they should send you a letter telling you why it was denied.

ok thanks... i did not received the mail yet. if i received the mail il update it here.

while i try to appeal or refile, can i renew my ead card? or can i continue working r driving?
