I cannot thank u enough for ur help...

I am dying and suffering here because most of the jobs i apply for s and even my license need me to be a green card holder

what I can do from my side to speed up the GC process?should i hire a lawyer?should i send them a letter saying that my I-130 priority date on my old application should be transferred to my new I-360?should i call them?

I am not a lawyer or anything.

So Sandra will correct if anything wrong

what I can do from my side to speed up the GC process?

nothing.

should i hire a lawyer? - you can, it will not change the process, nor time line

should i send them a letter saying that my I-130 priority date on my old application should be transferred to my new I-360? - you can, but it does not MATTER,your old was denied. So it does not matter what was the priority date on your old paperwork. It's denied. CASE CLOSED.

Forget about it and move on. Now it's only matter what is it in you NEW from

Anajic.you absolutely said the right thing.

I was just about to write the same thing. I don't know why vawavictim is asking the same question over &over again even after she has been answered, she is still posting in other threads. NOT COOL.I might have to unsubscribe to this thread because of her cos I'm tired of getting email alerts about the same person posting the same long questions over and over again. Sorry if I offended anyone but that's just how it is.

it's very easy.

She (or he) wants to hear the positive answer, something that she/he wants to hear.

Hopes that maybe someone will come and say "yes, it's possible" ))

For those of you who may find this info useful, after 3 months and 10 days since my I360 got approved I received an email saying that my case was trasferred to the local office. More waiting now. Trying to stay strong. Best of luck, everyone!

wow, that sounds long.

Did you try to make infopass appointment and tell then that your I-360 was approved and that they should send the case?

That is what my sister's lawyer told her to do.

"What if My Abusive U.S. Citizen or Permanent Resident Spouse or Parent (or U.S. Citizen Son or Daughter) Filed a Form I-130, Petition for Alien Relative, on My Behalf, Which is Still Pending or Was Withdrawn?

A. If you are the beneficiary of a Form I-130 filed by the abusive spouse, parent or child, you will be able to transfer the priority date of the Form I-130 to the Form I-360. This is extremely important for you if since it may result in an earlier priority date and a shorter waiting time for getting a green card.

Sandra,

I found some of your older post, where you talk about priority date that it can be transfered to the 360.

So is it a reason why my sister's petition was approved so quickly? because they automatically transfered the priority date? Or it is we need to ask it now? tell them to apply this priority date to the new process ?

She filed vawa in july 2013. Her priority date (said on the vawa approval is feb 2013)

She will have infopass on 20th. Does she need to ask them to use this priority date for her I-485?

Thank you all for your support.

1-My vawa approval has the word Class: IB1 what does that mean?is any body gettting different category?

2-what means by priority date transfered from I-130 (made with my ex who is US citizen ) to new form I-360?does it make it difference in time frame for LPR or UScitizen abuser?

3-May vawa approval has priority date which is July 2011(date of my old I-485) although my VAWA was accepted April 2012...what this means?

4-I found this post in another forum"I got my Green card based on VAWA. It was approved on July 28, 2006. When the card came, Resident Since date was June30, 2003. After doing some research, I assumed they granted me Permanent Resident Status since June 2003"

How this guy got this?

jessyL her vawa was approved independentement of her priority date, and as far I know her husband is American then she has already a visa number available, the rule I mentioned before is to spouses of green card holders.

vawa victim category Class 1B1 it means Self Petition-Spouse of a U.S.Citizen

The information you got is inaccurate. I don't believe he got his GC with a retroactive date, otherwise everyone would get right?

Your wife is American then forget about to transfer the priority date of your I-130 to your I-360.Yes it's different the rule for LPR and US Citizen

Vawavict it means your AOS was filed in July 2011,nothing else.BEcause your wife is a U.S citizen you don't have to wait years to have a visa number available.Wait a few months (2/6)and you will have your interview.

I saw many posts in the forums having "residence since" date is dated as the priority date not the approval date. That is extremely important to speed naturalization. Does anybody know why these people got new GC with "resident from “date which is 2-3 years prior to their approval dates?

Thanks.

sandranj

that is exactly my point...my old AOS was filed in July 2011 so I think i should have:

1-very early interview date in Chicago not wait like others

2-GC "resident from" date should be from July 2011 not any later date

Plz correct me if i am wrong

And if these 2 points are right, how i can secure these both rights?

Thanks.

That is what my sister's lawyer told her to do.

But my case was not in my local office, it was in Vermont. Where would I go for info pass? Vermont? I live in Florida!

Not that it matters for me anymore, but I'm really not sure if I could even do that.

But I wish your sister best of luck, and hope she will be more fortunate than me!
