You cannot, since you have not been a permanent resident and still aren't today. Whilst your first I-485 was pending then you were in a period of lawful presence, which then ceased when it was denied. You then went out of status until you filed your second I-485, and you are currently in another period of authorised stay which will persist until your second I-485 is adjudicated.

Persons filing for AoS under VAWA always have an interview.

I would expect it to take few months for Chicago to schedule your interview; there are people in this thread who have sometimes had to wait around a year for theirs.

Rohy I called last week. Officer said another biometrics were going to be requested since my first appointment was only for i-485

I am super anxious.

Sandra, thanks for your response, received email that file is being process at local office now, I didn't send medical remember? Well, maybe not, I needed shots but had to wait 30 days between each shot... So I suppose soon I'll receive rfe for medical... Looking forward, ead please hurry!!!

When you filed your prev I-485?

Did you filed new one this time or used the prev?

You mentioned EAD you got was based on July 2011's I-485. That might have expired July 2012. How are you using that EAD now?

I believe, first you will have an appointment for biometrics and they will run the background test on you again

Than if nothing negative will come up you will get invite for the interview.

Usually it is in a month after biometrics date (in California)

Do you know your field office?

If so you can check the processing time online

In NYC, NY

I-485 Application to Register Permanent Residence or to Adjust Status March 8, 2013

So it is 8 month, therefore expect to have your greencard in 8 month from october.

Though miracle can happen ))

For example, my sister's i-360 was approved in 3 month!! when the wait on is 13 month

As far as I know the date of the green card usually the date of AOS interview (if it recommended to approval on the date of interview). The fact of the VAWA approval does not grant any green card, it is just a statement that one is indeed suffered the extreme cruelty and has a right to apply for the residency, if other things will not disqualify the applicant at the time of interview (i e fail to pass background check, reunited with abuser, remarried etc.)

I do not know the nuances of that person case in 2003/2006, it also be that there were different rules 10 years ago.

Though I doubt that it will happen to you now.

My time line is as follows:

07/2011 applied to green card through my ex

09/2011 received my EAD

10/2011 my ex abused me and left home

11/2011 scheduled interview for green card but i postpone that appointment

02/2012 applied for vawa

02/2012 I-485 cancelled bec my ex revoked it

0/2013 VAWA accepted

08/2013 applied fro GC and EAD

09/2013 did biometric and sent medical

10/2013 received EAD

10/2013 file moved from Vermont to Chicago

So when will be the expected interview in Chicago office ?

How can I have GC”resident from” date of 07/2011 rather than 2013 bec I have old GC application in 2011

When I can apply for naturalization?since “resident from”on GC or from date VAWA approved or from date of issue of GC?
