Hi guys, I m new to this site, I see how helping you guys have been, May God bless and reward you guys. I, myself in need of some guidance. Married my USC spouse 6 mnths back. Knew each other for two yrs before. I was holding a visit visa. My spouse was going to do a Consular processing. But then he suggested me to come and have a vacation on visit visa and then I was supposeto go back. But unfortunately, it dididn't happen, he emotinally got me to stay here. He used to say its ok even if u get illegal, no one will get you deported. I disliked this idea and eventually he applied from onshore not lettin me go back to my place. Meanwhile, he used to abuse me a lot, make me wrk, not let me go out anywhere, I used to do everythng out of love for him. But later realized, he taking me for granted. Eventually I got pregnant, once I got pregnant I thot he would change himself for good. But no, he came up with another issue, telling me to file for a free gov. Insurance and that too as a single mom, not showing marital status to him. I didliked the idea of his. He used to go like don't you trust me and get mad at me. Eventually he started blackmailing me that if I dun't do what he's asking me to do, he will send me back n get married to someone else, I said ok. But for that also he got mad at me and went worse with his abuse, spitting on my face continuously, covering my head and punching me in the face. Scaring the hell out of me. Later he would come and say sorry and again repeat the same thing again. I got so scared to death, my heartbeat used to race looking at his behaviour, I thot some day if he kills me no one would kno, so I started voice recording, where he used to tranform into a monstor. One day he went crazy and wouldn't stop, being pregnant I couldn't take it anymre n called the cops on him and since the cops saw no scars on my face they left him, and I managed to fled from there for my safety. Next day I went to the cops again & this time made them hear the recordings, they heard them and got him arrested, I applied for an order of ptotection and got it. A hearing is scheduled for it within a week or so. I do have an EAD but, now its all a mess, interview was siupose to b nxt mnth. But with all this nuisance goin on, I dunno wat I m suppose to do soon. EAD will b gone. I have no family here, all alone and ptegnant. Please suggest me what should I do in this situation. Or from here

I agree that it may take longer and yes they transferred by petition to local office before my ead. Maybe they work on petition numbers in ascending order and my 485 is before 765 and 131, I m just wondering not sure though.

Cielo I know is hard, I am on same boat now, I am getting worried because same way some vawa petitions get approved within months others are taking way too long, I am fearing our ead's will take longer than their time frames :3

Samanda as far I understood you don't have an adjustment of status pending. You can file VAwa and you have the option to file for adjustment of status and work permit as well or just file vawa for now but then you can't get work permit with just vawa filed alone.FInd a free legal aid service to help you or if you are not able to find one contact me and I may help with your case ok.

hello sandranj i am kinda confuse again this is what they said to me...

Social Services should approve benefits for you. Unfortunately in the rural areas like here, or where you live, the agency doesn't always know they are supposed to be able to offer benefits to you. Sometimes you have to assure them that you're legally here, have a Social Security Number and are eligible under the law. Another good reason to call immigration and get them to explain your rights. Whether or not they give you benefits though, that has nothing to do with you staying in the country. The papers you received that accepted your petition (I-360) are the ones that prove you are legal to stay here for that period of time on the paperwork. If you don't file for your next step...the green card or work visa, before that time period ends, then they can have you leave the country. So please get the paperwork in for your green card as soon as you can.

Wat are you taking about the prima facie??? If so you don't have to use it if you don't want to. Nor does it disqualify you for you green card or a fee waiver so that info is false if that's wat they ate saying based on prima facie

You use your prima facie if want or need period! if you decided not to use it will not change anything in your Vawa case.We have here hundreds of people that never used any public benefits and their cases were approved.

I don't understand why is your lawyer pushing you to file AOS now, and giving you wrong information about the Adjustment of status. You can file for AOS after your Vawa is approved, you don't have any obligation to submit your AOS now. If your Vawa is denied and you have a pending I-485 they will start with removal proceedings, if you filed just I-360 and your case is denied they are not removing.

You use your prima facie if want or need period! if you decided not to use it will not change anything in your Vawa case.We have here hundreds of people that never used any public benefits and their cases were approved.

I don't understand why is your lawyer pushing you to file AOS now, and giving you wrong information about the Adjustment of status. You can file for AOS after your Vawa is approved, you don't have any obligation to submit your AOS now. If your Vawa is denied and you have a pending I-485 they will start with removal proceedings, if you filed just I-360 and your case is denied they are not removing.

I have attorney filed for i360, but i cant afford attorney fee for the rest

what should i do if i want to represent myself, am i supposed to fill out a form

What do you mean by "the rest" this my case: attorney over charged me to file VAWA, I hadn't find this site yet, but that included the whole process, anyway towards the end Sandra was my angel, she knew what was wrong, a weak affidavit, my facts were valid but the way they had been written was wrong I hadn't explain in detail. Then my case got approved, again mainly to Sandra's help. Attorney wanted to charge me same fee according to them he "finished" the job and the AOS and ead was a new case. Also they didn't want me to apply for fee waiver! It would have been impossible for me to pay all that money :3

However, thanks to this site I got the courage to file by myself because I read of many ladies who even file VAWA on their own. Also ,Sandra reviewed my forms before I filed.

hi everyone thx for share your experience really it helpful and give us too much hope one day we live in peace and vawa nightmare finish one day here is my vawa journey i apply in 21 june 2012 and i get approvde in 26 June 2013 and they transfer my I485 to uscis office NBC on 29 july and i dont heard from them i call my lawyer today to ask about my case and he surprise me he said i surprise the send deferred action with approval i360 maybe they will denied the case i dont know what going on is that weird to send deferred action ? and can they denied my I485 ? and how long take to set up interview it been no 4 month after my approval vawa

i have other issue my ead expired last september and still waiting even i write to uscis how much hard financial-ship i had but stay dont get any ansewer and it been 2month and 15 days now no approval what i should do

plz give me answer really am get sick of all that and sometimes i want to give up and go back to my country

Rohy you lawyer is a ####### lawyer.He doesn't even known what deferred action means.DEferred action means that y6Ou can't be deported until your deferred action is valid.File for adjustment of status now if you did not file yet.THere is no reason for your lawyer to tell your case was approved with deferred action and they may deny your case.Tell your lawyer to read about immigration if he wants to be an immigration lawyer.

Rohy uscis local office may take 3 to 6months to set up an interview,despite we have here some people waiting 9 and 11 months, then prepare yourself to wait maybe 2/3 more months.

sandranj thank u for your reply this lawyer from public orgination and i start to beleive he not dont help because he is free lawyer and am scare to lose my case if he go with to the interview what i should do ?

Rohy I saw many ####### private lawyers and great pro bono lawyers. It's not because he provides free legal service he is bad, your attorney is bad because he doesn't know the Law. If you do not feel comfortable with his representation, then remove him from your case and attend the interview alone.
