I just got the second rfe I'm so relieved all they want is a copy of the fake restraining order my ex filed against me.(While I was at the hospital,I saw two of his friends working at he nurse station,obviously they got acces to my file and they know te doctors and the DV rep told me to file a restraining order against him once I'm discharged, his friend went and tld him and him being very competitive decided to go get a fake one against me first.infact he ran to the court to get it, d same day I went to our house to get my stuffs with police escort).I was really weak then and I called the court to contest it over the phone and they said I must come in person. My question is, can I file a RO against him now cos I hve evidence he has been going around the city asking my friends where iam.I'm gettng scared and I need to get him off my back, will it help my case if I get him a RO and attach it to the copy of his "fake" RO? Pls reply.Thanks- for your time.

Back&brighter who is in removal proceedings and has a Vawa case can apply for Cancellation of Removal under Vawa, but the person must be be in removal proceedings. The alien must prove that he or she is a person of good moral character ,lived in the US the three years preceding the application, was victim of Dv or extreme cruelty and that the alien's removal would cause extreme hardship to the alien ot to the US child.The Cancelation of Removal only can be granted by an Immigration Judge,

Bestgirlever if you fear for your life you can file a Restraining Order, but in your case filing a Restraining order now after receiving the RFE it will not sound good. Just send along with your original RFE and e certified restraining order a letter explaining that you were planned to file a restrainnig order against him when you were hospitalized, and you commented with your friend about it, but she told him and in retaliation he filed a RO against you, tell them the outcome of the restraining order against you as well, mention you are a law abiding person, that you were never arrested or convicted of any crime in the the US or worldwide.If you do not have an attorney draft the letter and if you want send me to review ok,send me through pm here in the Visa Journey.

Ok- thank you I will go ahead and start the draft right now and I will pm it to you. I will file the RO against him nextweek and I won't attach it to the rfe but its just for my safety cos he is too violent and has a tornado temper so I want him as far away from me as possible. Also when u say e-verify restraining order pls what do you mean? And also telling the outcome of the R0 against me, does that mean how the false RO made me feel? I'm sorry but I just want to know how to write my letter. I'm sorry you said "e certified" not e verify. But I guess that means I should just photocopy the false RO and attach to my rfe. I guess I would say it was granted? All I got was what the officer gave to me as I was picking my important docs frm the house and I was too sick to get to the court to contest it.would that qualify as granted??

Bestgirlever did you to the COurt hearing on the Restraining Order? The hearing date was on the notice of Court hearing? If you went what did the Judge decide? If you didn't go,why not?you need the transcript of the hearing showing if it was extended the Restraining order or canceled.GO to the Court and ask a certified copy of the Restraining Order court hearing.

It has no court date on it. There wasn't a hearing at all. All I'm seeing on this is the issue date, date it was served ONLY. Shows nothing for any hearing.I've never had a RO I didn't know if it was supposed to have a hearing date as it is not here. Why do you think this doesn't have a hearing date though?

Sandra I just got off the phone with the court! She says my ex hasn't showed up since the false RO was issued out to him. And that the only thing on the file is the day it was iSsued and the day it was served that's all. And she said I can request a hearing day if I want. Do I fight this? Cos I do want to get one against him cos he is already running around trying to find out where iam. Or do I just go ahead and ignore his false RO and get mine?
