cielo did you file an e-request? well the E-Verify is unavailable due to the federal government shutdown, but when the shutdown is over fill out this form and submit a request ok.

you can call USCIS,not Vawa Unit, and ask to speak to a TIER 2,and find out what's going on, when you call some representative will answer your call right away tell" I have a valwa case pending and I submitted form I-765 I need to speak to a tier2". The Tier 2 is always an immigration officer, the first person who answers the phone is not an immigration officer.

Citragirl when you call Uscis just say about vawa pending when you speak with the first person, because they are not allowed to give information about vawa cases then saying that you force him to transfer you to speak to an immigration officer known as a TIER 2,but ask him to speak to a TIER 2,but ince speaking with the officer say your Vawa was approved and ask about your I 485 OR 765.

Hello Ishka86, Any news about your decision? how many days after the finger printing was interview and are they very interrogating at the interview.?

godisgreat23 not on interview ask all questions, usually it is standard questions: your birthday , what day you arrived to America something like that and duration is no more than 10 minutes.

In my situation I was hold in the office for 45 minutes from which to me crush questions:
as I arrived to America, what number to what city, all questions from the form i-485
then it considered my photos and told that I don't think that there will be any problems wait the answer within 2-3 weeks
And only it started closing my file it me asked as called the church who married me, and to what exact address I got married, haw did i find this church , if i'm religious and if my ex husband religious , and if we had religious wedding.
then she asked as called my lawyer who was engaged in my divorce cause and if my husband was in the court for divorce . Then she told me OK wait your answer by the mail Bye.
If to be honest it was very strict and when I came and she only started talking to me I lost a speech i didn't expect that will talk to me so roughly. She didn't smile at all.

SAD056 the Law States under INA § 204(g), an alien's spouse cannot petition for the alien based on a marriage formed during removal proceedings unless the alien leaves the U.S. for two years after getting married, because there is the presumption the alien got married to avoid removal,you did not file for AOS, but your married occured when you were in removal, I suggest you find the best attorney possible because your case may get ugly due the nature of your case Asylum-denial-removal proceedings -got married-separated-Vawa.. You need a great attorney to help you. Yes it will be damn difficult to prove bonafide marriage in your case.

sad0056 in your case is not about how many proof you have, it's about the reason you entered into marriage when in removal proceedings, they tend to believe the alien got married to avoid removal.USCIS cannot approve Vawa without an exemption it means you must request an exemption under INA § 245 (e) (3); 8 C.F.R. § 204.2 (a) (1) (iii) and § 245 © (8) (iii) ok. Find a pro bono lawyer to help you and remind your lawyer about the exemption,because we have a case here in the visa journey their lawyer didn't ask the exemption and the case was denied.Once they grant the exemption ythey may approve your case if they find proof of bonafide marriage and abuse.Did you suffe mental abuse? do you have a psychological evaluation? do you have a diagnose of major depression or pos traumatic disorder?otherwise they will not approve your case with base in extreme cruelty. Are you goinf to therapy?how many sessions you had until now?

I read a few days ago about one decision in the Court of Appeals about one guy who filed asylum a few years ago and it was denied, he got married when in removal,had 2 children with his wife, but his case was denied and the BIA denied his appeal as well, they did not believe he got married in bonafide and keep in mind he had 2 kids with his wife,he was removed from US, he was here less than 10 years then he could not file for cancelation of removal.

Are you living in the US over 10 years? do you have an american child?

Need your help. I got no update on my 765 or 131 but for 485 got the update message from USCIS and the status is still "initial review". I m really worried, can you please help me what does this message means.

Doneher it means they transferred toyour case or to Missouri in order for them to make sure you have all forms ok or they transferred to t you local office,most likely they sent it to Missouri and once everything is fine they will ship to your local office for you to attend interview.
