Hello piper2013, I'm in the same situation as you are. But I filed 485 togheter and now waiting on interview. Did you provide them police report?

I hope I'll be done soon, it was a nightmare for me!

Thanks. I submitted a lot of paperwork, proving the bonafide of the marriage - many pictures of us together, as well as together with our families, love letters and notes, e-mails, phone records, a joint lease, a joint bank account, e-tickets for trips together, utility bills. I also sent affidavits from several friends who knew us together and who wrote about both the romance and the emotional abuse they witnessed her commit. I also sent a letter from a psychotherapist, detailing my therapy, depression, and circumstances. I was so devastated after the way she treated me that I went to therapy for about 6 months. My personal affidavit was very detailed and I am lucky to have friends that took this very seriously and also wrote detailed affidavits. I have heard from several sources that a joint bank account is strong proof and that without one a case is likely to be denied. My wife and I did share a bank account because we were saving for our future, for having kids one day, etc. So I didn't have to worry too much about the bank statement. I think that an honest, well-written affidavit is very important in order to show both the seriousness of romance and the failure of my marriage due to my wife's out-of-control, abusive behavior despite my best intentions to be married to her for love, which was the reason I lived together with her, got engaged to her, and married her. I was unsure as to whether to submit the I-360, because I am a man and I have heard that men are likely to be denied. I deliberated a lot. My friends and even the therapist encouraged me to submit the petition, so I gathered up courage and did it. I decided that based on everything that had happened, perhaps somebody would give an ear to an honest account of good intentions and unnecessary pain due to abusiveness. So I explained my relationship in a very detailed way and supported my account with all kind of evidence I could think of.

1. Where does one file I-485 based on an approved I-360? I'm filing them separately? Chicago, Vermont or Dallas? According to this website, all 3 accept I-485s based on approved I-360... Any ideas anyone?

2. Another question: Is an Affidavit of Financial Support necessary if the I-485 is based on an approved I-360?

Alright, sandranj has responded, for which I thank her.

I-485s based on I-360, but filed independently, also go to Vermont. And I-864W takes care of I-864 (Affidavit of Financial Support).

Good morning ALL, I havent written a quote in a long while...I've been reading everyones post finally26122012 hang in there I truly feel for you its been a year since you got word is your lawyer looking into it? Congrats to all those who go approved and their EAD praise God!!!

Anajnic any interview date yet? Lank how have you been my sis? Im not seeing any quotes from PanamaGuy!!! Well im still waiting on my interview date as well been approved since June and case transferred my lawyer made a boo-boo and sent my I485 application again so im trusting God that it doesnt cause any confusion.

Hang in there all my VJ journey-ers we are all in this together keep believing God he is the God of the impossible.

Faithkeeper unfortunately I don't have much news to share. It's been 16 months now since I files and nothing. I asked congressman office to inquire. They did and came back with an answer that my case is undergoing security clearance and once it's complete, they will adjudicate my case. They also say that they don't know how much longer clearance could take. I am very frustrated with all this waiting game. Hopefully, it will be over soon. I also filed for another prima facie because my current one expires on October 14. I filed a month ago and still nothing.

After things between us ended - because I chose to run away and save myself from her abusiveness - I went to the interview by myself and withdrew the I-485 application.

I am also in similar situation like you were. But you're out of it now and I am not yet...

Couple of questions:

- Did you withdrew the I-485 or just informed them that you're going to file VAWA?

- How did you find the psychotherapist? Do we need to find Forensic psychotherapist (they mentioned something like that)?

I have called many but most of them don't know about the immigration process. How to find one that can provide proper psychological evaluation report as well?

- Did you apply based on mental abuse? What did you provided related to abuse?

- Yes, I withdrew the application completely. Then I did VAWA months later.

- I found the psychotherapist by calling an organization that does psychological work with foreigners. They told me they couldn't take me, because there was a long waiting list and because I wasn't Latino. The organizations exclusively does work the Latinos. They directed me to another psychotherapist, a private one, who they said had expertise working for foreigners. So I that therapist, set up a meeting, liked it, and continued going to therapy. 2 months into it I asked for a letter of evaluation. I continued going to therapy 3 more months after receiving the letter, because I needed to. I don't know what a proper psychological evaluation means, really. Mine describes the circumstances, gives a diagnosis, and explains the efforts I'm making to improve my situation through therapy.

- I did apply based on mental abuse. The things I provided were: my own detailed affidavit, the letter from my therapist, and several affidavits from people who knew the situation. I was concerned this was not enough, but then I thought that since the abuse I experienced was mental, this might be enough. I had no police reports, because I never called the police. I had no pictures of bruises, because she never beat me up. However, there was a pattern of abusive behavior that I described in great detail in my own affidavit. The affidavits from those who knew about it supported me by giving various stories of abuse and manipulation that the people who wrote them had witnessed.

I am glad the petition was approved. I didn't expect it would be, because I hadn't experienced anything that I could show through police reports or pictures. But mental abuse exists and, although not easy to show, it is no joke. As long as you know that you were married in good faith and that your spouse acted abusively towards you, it is worth giving it a try. Good luck to you!

Piper2013 the information/sources you had that a joint bank account is strong proof and that without one a case is likely to be denied, it's not a correct source, since thousands of people filed Vawa without having a bank account or any commingling finances, of course if you can show commingling finances it will be easier to prove a bonafide marriage,but it does not mean they will deny a case because the person does not have a joint bank account or utilities bills in their names. Just in 2013 I helped over 30 people here from Visa Journey because they asked my help after they got RFE to prove bonafide marriage.I was able to explain why the aliens did not have any commingling finances and all of them were approved without any problem. Vawa Unit knows that most of the victims were controlled and did not have any chance to have any commingling finances.The alien of course has to explain why he/she did not have a lease agreement, utilities bills in name of both,joint bank account,joint tax return etc.

It's great that they approve petitions even in the absence of a joint bank account. That means that people are really allowed to make their case even in the absence of what many people think is a necessary condition (the bank account). There is hope for many - don't give up! :-)

Most of the adjudicators do not ask any question, just ask to see the original documents and that is it, but some adjudicators ask everything about the courtship,wedding and commingling finances. They can't ask about the abuse, but they can ask about the marriage.
