Hi,

I'm new here, but I have been reading this forum for a while. I have good news to share: my VAWA petition has been approved 6 months after filing with Vermont. I am male and I submitted my petition entirely on my own. I am happy to answer your questions about how to file a strong VAWA application, especially as a male.

I now need some additional advice as I am in the process of preparing my I-485 application. I would appreciate your thoughts. Here is the short of it. My wife and I had filed I-485 and I-130 together in 2012. After things between us ended - because I chose to run away and save myself from her abusiveness - I went to the interview by myself and withdrew the I-485 application. The I-485 application was at this point complete, with the medical exams, filing fees, and even my fingerprints had been done. However, we were to be no longer together, so I withdrew the I-485 application (an immigration lawyer told me that it was better to withdraw it than to have it denied). Months later, I filed under VAWA, which was approved last week. The I-360 approval letter says that I need to file my I-485 with the local office. My question:

Is it possible to have the local office reopen my old and already completed I-485 application from last year as I have passed all medical requirements and even the fingerprints? I hope I can reopen the application and save myself another $1000+ on fees, fingerprints, and medical exams... If they allow me to do so, this would save me time and money, so this is a huge plus.

The potential minuses and problems are: 1. I am not sure if my medical exam from 2012 will be still considered valid; 2. I am not sure if my photos submitted with last year's application will be still considered valid/recent enough...

In short, is it possible to ask the local USCIS office to just use the approved I-360 in lieu of the old I-130, and thus to reopen my I-485 application, which is completed, but which, however, was submitted in 2012 and subsequently withdrawn by me?

I would appreciate any and all advice. Also, please don't hesitate to ask me questions regarding the approved I-360. This forum has provided me with great information and I am happy to help with advice if I can. Again, I am a male and my VAWA petition was approved 6 months after filing with no RFEs. I am very happy and lucky to have liberated myself from a very terrible and abusive situation and to passed this first step towards adjustment of status. Now I need to make the second step (I-485) and would appreciate your advice.

Thank you.

Piper2013 File a new I-485 and just fill out form I-912 to waive the USCIS fees, and the only think you have to pay is the medical exam, search in the internet and you will find complete medical exam for $250.DO NOT t file I-290B , the I-290B is used to file a motion to reopen or reconsider on a denial/revocation case , it's not your case.We use motion to reopen the denied I-485, you withdrawn is completely different, and the medical exam is valid for 1 year.

Thank you, sandranj! I will follow your advice. I will be back with more questions and commentary as the I-485 process unfolds.
