Hello,

I am working on an OPT Extension right now. And my OPT is expiring in 2014 march. And I am going to get green card through my finacee who is a US citizen. We are getting married in couple of months. And I am calling my parents to attend our wedding in states. But my student Visa (F-1) is expired. And even though I have a valid OPT extension, I am afraid that they might reject my parents' tourist visa.

So me and my finacee were thinking if she could sponsor them, as in she can sign the I-134 form instead of me. And she can put down the reason that they are her friends or maybe future parents in law. And she can also send documents like her Bank statement, address proof and pay check.

If I try to sponsor them and their visa get rejected, then can my finacee sponsor them and get them approved? Or should I have her sponsor them to begin with?

Please shed some light on which option is better and less risky. Do you think it might cause any complication?

Your status in the US (being in OPT extension) will not have a baring on their tourist visa

You cannot sponsor them, they need to qualify on their own

Thanks for the response.

But then why did their Agent told them to have me fill up I-134 form?

I have to fill two forms for each of them and then describe that I will be taking care of them and they wont be a burden on US soil and stuff.

Am I not required to fill this form at all??

Their Agent loves to collect forms and fees.

Bear that in mind as you're reading the 'How to Apply for a Tourist Visa' on the NIV portion on any embassy website.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Exactly as posted by “Asia” that was just to make you feel more comfortable.

All you need is DS-160 one for each applicant – do the online version (not sure which consulate you are applying to atleast Mumbai everything is online)

Make payment via HDFC and they will give you receipt using that book your appointment.

You can write a letter, you would be bearing the expense for the trip also you can include your bank statement from US.

On Indian side your parents need to present their assets, including property, bank balance and other investment, business etc.

My parents' tourist visa got rejected. The consulate office did not even look at the papers. They interviewed my dad and mom together, in Hindi. They asked my dad about some questions about where he visited in the past, outside India. He visited many places like China, Singapore and neighboring countries. But he also visited, Kazakhstan for work purpose. He mentioned this to the consulate office.

And soon after that he returned his passport. I am not sure if that could be one of the reasons his visa got rejected, but I am really surprised and scared.

He is going to apply for it once again next month. But I want to know what are the chances that he visa will get rejected once again? Do they look at the previous reason? Can we prepare, with the documents, in a different way? (Given that they atleast look at your documents). Should I hire a lawyer to do so?

Please advise.

I say , since they used an agent, and paid monies to an agent,

that your parents should go back to the agent and ask the agent WHY they were denied

and then report back the answers from your parents from the agent, here.

The chances of them being denied again is high if there are no changes in their circumstances. Sometimes people are lucky and get a different CO who is more accommodating.

Of course, they will have the notes and reasons why the prior applications were denied.

There is no document that you can send to change things. What documents would you submit to show you parents will return? (Anything relating to you does not show reasons for your parents to return. You and your support could be viewed as reasons for them to oversray their visas in the US.

A lawyer is useless. There is nothing a lawyer can do. It would be a waste of your money.

No lawyer involved here, and Agent.......

I would be asking the Agent, he was presumably paid by your parents, time to earn his or her money.
