We received our RFE for our AOS. I just need help understanding how to avoid this in the future.

"A review of the record indicates that you endtered the US pursuant to a valid k-1 nonimmigrant visa. All USCIS records relating to you have been reviewed. THe US Department of State medical forms DS-2053, DS-3024, DS-3025 and DS-3026 were not forwarded by the Department of State.

The form I-693 vaccionation recorred you submitted with the Form I-485 was received and meets the vaccination requirements. However, because your medical evaluation was not forwarded, you will need to locate a civil surgeon and complete the medical examination portion of the form I-693."

So, if we bring this to a civil surgeon, have the medical examination portion completed, and we send it in a sealed envelope, we should be fine, right? As at this point we would be skipping the middle man (Department of State). Is this the norm for the DOS not to forward the medical examination portion?

They lost your medical. That sucks, but it happens from time to time. You will need a new medical from a USCIS-designated Civil Surgeon. You can bring a copy of your vaccine part so you don't need any shots. Call around and ask for a price. try to find one who can do it for $200 or less. Good luck.

That's so annoying!! We filed in Jan '12 and we are just now hearing this info. I wish they would've told us sooner.

Regardless - if we do a totally new medical exam and send it in the sealed envelope, we should be okay, right? Do we need to do a cover letter for this? I am so scared I'm going to leave something out and just get the flat denial as they don't give you a second chance on an RFE...

Also - what happens if the envelope the civil surgeon doesn't fit in the envelope they give me? Is it okay to send it in a larger packet?

You are just hearing now because they went to approve your case but found a part was missing.

Yes, it is really annoying. It means the packet you gave them at POE didn't get to USCIS.

But yes, just do the medical, send it back with the RFE letter, and that's it. The CS will give you the results in a sealed envelope. Send the sealed envelope back to them.

A lot of people adjust their status in country, so getting a medical in the US is a normal thing.

Okay, thank you so much for all of your info!!

While I'm frustrated I'm just happy it wasn't our mistake that got us the RFE!! Hopefully once it's returned we will hear shortly - and not have to wait another 1.5 years!! I'm assuming if they were going to approve the case then saw this - we shouldn't get another RFE, right? We are expecting twins in Oct and I really wanted him to have his green card (stability) before they arrive!!
