Hello,

My husband is here under a K-1 visa, we got married time passed and we sent the application to remove conditions.

First, in November we received form I-797, notice of action it says

"your conditional resident status is extended for a period of one year. During the one-year extension you are authorized employment and travel."

Second, we received an appointment notice for biometrics, which he attended already in Dec.

Third, We were hoping to receive his 10 year permanent residence card, but we didn't.

We received I-797E RFE (request for evidence) due in august.

Here is the problem, Months ago we had bought tickets to travel to Mexico. We don't know what to do. His 2 year green card expired in January. But remember we got a year extension. So, I called USCIS twice to see if we could travel, just to make sure. and I got 2 different answers. First, I got told I had to fill out form I 131 - application for travel document. Second time I got told, We could travel, because we got a 1 year extension, that all we had to take was the expired green card and extension letter I-797 that we received. That the permanent resident card that he has right now has the same rights as the 10 year. I am confused and just want to make sure.

So, I am seeking your advice. We have the tickets already to leave in the next coming days, but want to make sure we he can come back.

You can travel using your original (not a copy) extension letter and expired green card.

Check with the airline as they are the ones that will either allow you to board the flight back to the US or cause you grief because they are morons. You are allowed to travel using the ORIGINAL extension letter and the expired GC. No copies.
