Hi,

I'm filing an Ir-1/Cr-1 visa for my husband. In the "What Visa Do We Need" guide, it says the total cost for this visa will be $904. However, it looks like we have to file an i-130 and an i-485 (among other forms) - the i-130 costs $420 and then i-485 costs $985 - do I need to file both of those? is the total 420 + 985 + the cost of any other forms?

Yes - he is here in a tourist visa. When he entered, though, we had no plans to get married - it was a spur of the moment decision. Thanks!

So you are not filing a spousal visa you are filing for adjustment of status while he is in the USA? if so you are looking at the spousal visa cost not the adjustment of status cost. Its going to be very expensive to file adjustment of status while in the USA.

130 = $420

485 = $1070

Medical = $300 more or less depending on the civil surgeon you go to.

In the link in that response, will I need to follow the steps for assembling the i-485 packet, instead of the i-130 packet?

So - the i-130 form/packet can only be used if the spouse is not in the us?

You are confused about what process you are doing.

Your husband does NOT need a visa. Visas are for entering the US. He already entered. No one lives in the US on a "spousal visa." They obtain a spousal visa which upon entry to the US turns them into a Lawful Permanent Resident.

Your husband already entered the US on a visa that does not make him a Lawful Permanent Resident. He can leave, go home, and obtain that visa and come back. That is one option.

But the other option, the one I suspect you will want to do, is to file for him to become a Lawful Permanent Resident in the US without having to leave. To do that, you will file a CONCURRENT I-130/I-485 package. The I-130 establishes a spousal relationship and makes him eligible for LPR status as the spouse of a US Citizen. The I-485 is the application for LPR status itself. Those are the two main parts (the parts you pay for) but there are a host of other forms to fill out as well.

You do need to do EVERYTHING in the linked guide.

You need to read the link again very very very carefully it most definitely does include the I-130. You need to follow every single step in the guide, from top to bottom.

You are not applying for a visa. You are applying for adjustment of status to get him a green card.

Got it - thank you guys!

I'm filling out the I-864 now. I was a student in 2010 and 2011 and out of the country in 2012 (not working), so I wasn't required to pay taxes, and I'm not even sure how much I earned. I started a job Jan 2nd of this year and my salary here puts me well over the poverty minimum - do you think I should get my mom to joint sponsor, or will my income for this year be enough? Additionally - how do I answer the question about having filed federal taxes in the past 3 years (there is a check box). If I'm not sure how much I earned in 2010 and 2011 in my (part time) jobs, where could I get that information? The place I worked in college no longer exists.
