Does i-130 really get transferred to local field office?

SO does the i-130 really get transferred to local field office or does it stay at NBC until approval?

I am asking because a lawyer friend of mine is insisting that if the spouse is not in the US but rather overseas, then the i-130 does not get transferred to local field office at all. It will stay at NBC and get approved there as well.

I told him that when i called the USCIS they clearly told me my case was transferred to NY local field office. He says, ah they dont know what they are talking about. Each officer will give u a different story.

So i wanted to know from you guys what the reality of the situation is.

IO's don't lie, they don't have any reason to.. they are looking at screens and reading it back to you. It is true that some wont take the time to dig through the various screens for answers.

If you have the time and want to shove a shoe in the lawyer friends mouth take an infopass and you will confirm it is at the office.

nbc has been doing this for at least six months to alleviate the backlog they have

I confirmed my file was at the local office with an infopass

check for some strings about your office to see if you can find out two things:

1. how fast they have been approving (totally dependent on workload)

2. have files been sat on at the office before they have been forwarded to nvc after approval... mine was there for seven weeks.. the longest I read here on VJ is 3 months.

good news is that you should be getting your approval any day now.. knowing what I know about the forwarding issue, I would still try to make an infopass scheduled in three to four weeks from now for follow up

i totally agree with u. they told me my case was transferred on the 22nd (i think) of march. I will be going for an infopass very soon, Just giving it a week or two more before i go.

Ours got sent to our local office, and 2 months later it got approved. Like Stevie b said "If you have the time and want to shove a shoe in the lawyer friends mouth take an infopass and you will confirm it is at the office". However if you WANTED to, you could try to get ahold of a tier 2 person and ask them then call again couple days later to see if u get the same response from different Reps. But if they said it was sent to local office, its GREAT chance that it really did and its normal for them to do that now. Hope this helps and good luck

A. NBC's current processing time is 4-6 months for I-130. And yours is in process and only been close to 3.5 months, so wait till mid July and I am pretty sure you will hear something back. ( I then asked whether it will be in PHX field office so i can take an infopass appt to be updated on status) Is your spouse living abroad? (I said yes) and he said then it won't be transferred, only if they need to interview anyone, then its normally transferred to a field office.

an infopass will not get you anywhere unless your file is there or if you are beyond processing times and nobody will help you

Are both spouses out of the country? Did you put a USA address anywhere?

mine for my stepkids went to local office and did an INFOPASS because I was told it went to an asylum office that was local to me. But as the asylum office does not do infopasses, I did one at the other regular local center. When I got there, they pulled my file which was there and approved it on the spot. Make sure your bring all your files with you Just in case they "lost" anything. Check out in my sig line.

My wife is in South Africa. Im the USC and i live in NY.

mine for my stepkids went to local office and did an INFOPASS because I was told it went to an asylum office that was local to me. But as the asylum office does not do infopasses, I did one at the other regular local center. When I got there, they pulled my file which was there and approved it on the spot. Make sure your bring all your files with you Just in case they "lost" anything. Check out in my sig line.

well for me being so impatient called one day and got to know it was at local field office. 2 days later they told me its at vermont! and then few days ago i called they saying NBC i don't beleive these ppl every person i talked to they gave me the info i already know .when i insist for the location they just make up some stuff. I guess i have to talk to tier 2. but no one fwds me to tier 2 officer so i don't know how people get to know so much about their case.

Timeline

well for me being so impatient called one day and got to know it was at local field office. 2 days later they told me its at vermont! and then few days ago i called they saying NBC i don't beleive these ppl every person i talked to they gave me the info i already know .when i insist for the location they just make up some stuff. I guess i have to talk to tier 2. but no one fwds me to tier 2 officer so i don't know how people get to know so much about their case.

Are you able to check your status online? If so, then you would have to demand "politely" with the CSR to be transferred to Tier 2.

If you can not check the status online then CSR would not be able to tell you anything about the case so by default they would have to transfer you to Tier2.
