For the record here is the Embassy's response when I re-emailed them asking it it "were possible". I was referring to the law and precedent and not specifically wether or not they would say 'yes' to me. I made that abundantly clear! Yet their response basically is "please apply, pay the fee, and then we will answer" !!

We understand that you would like to make it clear prior to filing petition, but unfortunately, we are unable to respond to this type of question if we have not received the physical case file from the National Visa Center.

The US government does not want to give out legal advice. Answering your question about eligibility to immigrate falls into the area where you should consult a lawyer for legal advice.

it isnt legal advice. I am not asking if I personally have a chance. I am asking the straight question: is it possible or isn't it for me to domicile abroad, the wife live in the US and care for our daughter. It flat out is a yes or no in terms of the US policy. Wether they approve me or not is secondary to the question.

No. It's not possible.

Family based visas are for joining the families.

You won't be joined if she's in the US and you are abroad.

Your child is too young to sponsor her.

All the kinds of visas are explained in the govt sites. They won't answer your question regarding this subject.

You are asking if it is LEGALLY possible. That's asking for legal advice.

While it may seem to you that you are asking a general question, your question is about if something is legally possible.

The US government's stance is that answering these types of questions is giving legal advice.

While you may diagree that you were asking for legal advice, that is not the US givernment's position.

I'm not here to argue whether your question is asking for legal advice or not. The US givernment's stance is that questions about the eligibility to immigrate will not be answered and only specific questions can be address in a specific petition.
