Hi everyone! It's been a while since I have been online due to Ian and I finally making it over from the UK to NY. As soon as I have time, I will sit down and properly write up a report of how things have been and what we are doing. For right now, I need a few questions answered please. Right now, Ian and I are debating whether we should follow through with the CR-1 and have Ian fly back for the interview, or if we should start his change of status on the K-3 visa. We are close to Buffalo and were told before that we could go there and file for the change of status but when we drove up there, we found out that they are no longer accepting the applications and we now have to go through Chicago, which of course takes longer. Our question is this, the big visa has been approved on this side, now we are just waiting to send in the 70 dollar fee before they can go any further. What would cost more? Doing the AOS, or following through with the CR-1. Can anyone please help us with this? I thought that the AOS would cost more money and take longer. WHat are the opinions of the group here???

If going thru with AOS, filing fee is $325 + $70 bio fee and possibly an interview, if your going with the CR-1, your fee is: plane ticket + Affidavit of Support fee ($70), the visa fee ($380).

The cost difference really is the airfair. As you haven't started the NVC process it may be preferable to adjust status from the K-3 as you are still looking at 2-3 months at NVC, whatever time it takes to be forwarded to the consulate, and the time it takes for an interview to be scheduled. So all up you are still looking at approx 5-6 months until a CR-1 interview. On the otherside, from all I have read, adjusting status can be a right pain in the butt.

Thanks guys! So I guess my next question would be this, if we contiune with ajustment of status, how long would it take for ian to get his employment papers?? That is the real concern here as I am not yet working (but actively looking).?! Thanks so much guys for the help.

I'm not sure on the timeframe but I do know that he can apply for the EAD even if you decide you are going back to do the CR-1. Have a look in the 'Working & Traveling prior to getting a Green Card' forum for an idea on how long it takes to get the EAD.
