The I-130 by itself does not protect you or give you status in any way. You are currently here illegally and subject to deportation at any time.

If you file I-485, that will protect you and you will be in a new period of authorized stay.

So you can file I-485 at any time, sure, if you want to live illegally and maybe get thrown in deportation jail for fun.

File the I-485 packet now. Ignore the wording on the approval notice you got. It doesn't matter. File now.

you won't submit just form I-485, you just to submit medical exam (I-693), affidavit of support(I-864), if want to work before getting the green card submit form I-765.Do no file out form I-131(advance parole) you are already out of status and G-1145, and proof that you submitted form I-130.

For sure I will file the I-485 asap. Im on it right now, but i dont think is likely for me to be deported cause im the mother of two american citizens, plus the wife of an american citizen, so the thing is a bit more complex.

Also will go to an appointment to the local USCIS office to get a bit more of info on the matter, cause i absolutely want to have all my papers on rule.

What puzzles me is the fact that people on USCIS customer services dont seem to know anything at all and do nothing but giving contradictory information.

You are wrong. People who are the parents of US Citizens and the spouses of US Citizens get deported all the time.

Well, I called again and they said that according to their registers, I was supposed to send the I-485 plus I-864, 765, 131 and 693. Also that I should send a copy of my I-94, so I could prove that I entered the country legally (never sent that before...), and that should be alright. That even though im currently out of status, cause my permit to be in the states as a tourist expired, I have an I-130 approved, and though that doesnt grant me any visa status is a proof of the fact that I am setting my status straight, so shouldnt have any problems.

you haven't submitted proof of your legal entry or anything else. You can submit new information with your I-485 package that will show you are eligible.

So they told you what we have been telling you this whole time.

What are your plans?

Send all those silly forms.. get a job not to get so bored in here and go see my family, as soon as i get my permit to travel.

It depends on how long they've been out of status.

If you leave the country being out of status, how do you re-enter? Wouldnt you lose your priority in the GCard line, so to speak? Wouldnt you have problems to come back? You absolutely need the I-131...no?

Yes, I guess you were right. Thank you! I did entered legally (not like I can swim from my country to here, or ride in a horseback...lol), and though I added the number of my I-94 card and all that, I dont know why could they not be sure of my legal status...

Ur i130 is approved but it still has not gone to the NVC u cant apply for adjustment of status until the NVC also approves u so thats the next step they will send ur case to the nvc so u should hear from them soon its good news congrats

YOU were right! I just received a letter from NVC saying that i just became elegible. They assigned me a visa number...told me i have to pay 88 dollars (i dont understand that yet) and whatnot. Have to sit down to understand it all carefully. So...THANK YOU!

If you pay the $88 then you are doing the wrong thing. I suggest you get a lawyer to help you with the steps.

DId you send the I-485 yet?
