RFE Returned - Now What?

Hello:

My fiancee and I received a RFE last week. The request asked me, the petitioner, to provide a letter of intent notice that I planned to marry my fiancee when approved. I provided this document when I submitted the orignal K1 Fiancee Visa packet and have verified copies. I am unsure if they lost the document or not.

I overnighted the document as soon as I completed a new form and it now states online that they are reviewing the document as of June 5th.

We submitted the K1 Fiancee packet on January 23rd, 2013. Does anyone have any guesses of when we should be expecting a NOA2? We are just getting anxious and excited about the possibilty of being approved. Thank you very much for your time!

Can't quite answer your question as you seem to be pretty much 2 weeks in front of me across the board. I am still waiting on my RFE in the mail, but I expect mine to be similar. I didn't send her original in though, because she didn't realize I needed the original when sending me her documents. I submitted a copy so I expect that will be what my RFE is for. I did have her bring over the original when she visited as I thought it could cause an RFE, so if that's it I should be alright submitting that.

I am curious though, since they want an original, and you had already sent that in, did you send a copy and explain that you'd sent the original with the petition, or did you make a new original and send it in to them?

I will be interested to follow your timeline and see how the timing is for your RFE to gauge how mine may go. If it's not too much trouble, could you add the RFE info to your timeline? Thanks

Thank you for your reply. I created a new letter of intent in my own words. Orginally, I used the template that was provided on this site for both her and my letter of intent. I realized I made one very small error in my own letter saying I cannot wait until "my" arrival and it was supposed to be "her" arrival. This error could have led to requesting a new letter or again it may have been lost in the many documents I provided.

I will work on the timeline later this week. Once I created a new letter, I overnighted it immediately to the California Center. Within one day, they updated the system that they are reviewing my response. I found that very positive since previously I had heard nothing since in close to three months. Best of luck to you as well in this tiring process! Thank you to anyone else that can share their input or insight.

Thanks for the update. I have already gotten an express mail envelope and am ready to send it (assuming they don't ask for something more). I am also going to express it directly to the address on the RFE, so I would assume our timeline's will be similar. Best of luck to you. Hopefully they find your new letter sufficient and you have your approval very quickly. I've heard many reports about RFE taking from a few days to a few weeks after they have been returned, so it will be interesting to see what happens here. I wouldn't be surprised if you were approved this week sometime.

I had the same RFE plus proving we had met in person. Both of which we had originally provided. We USPS priority overnighted the reply and we received our NOA2 3 days later! Good luck!!!

so did you just re-send them the same thing? since you mentioned you sent them that already on your original submission.. OR did you send other evidences (the ones they don't have) ?

no, we changed everything. On the letter of intent, we found in this forum and in the wording of the RFE, that we simply stated we would get married. The letter of the RFE made it pretty clear they wanted the words: will get married within 90 days of arriving to the US. For the proof of meeting, we had all the information, but not really organized and easy to follow. We put 4 trips together, with a cover letter for each trip describing the evidence provided, highlighting visa stamps, credit card statements for that trip, and other details. Then we put a full scan of my passport and her passport. 3 days later, we had our next gate passed!!!!

[My Mistake 2]

Received cell phone text on June 3, 2013 at 11:46 a.m. that states "Case Status Change."

Website reads:

On June 3, 2013, we mailed a notice requesting additional evidence or information in this case I129F PETITION FOR FIANCE(E). Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail.

Received hard copy June 7, 2013 and they are asking for intent to get married within 90 days of arriving to the US, which we had already sent both original signed intent to marry documents the first time. Waiting for fiance's signed intent letter that was send express mail to arrive from his country to me, either today or tomorrow and I will send it out overnight/next day service with both his and mine original signed document together for intent to marry. USCIS should get it no later than Thursday, this week. YES, the intent to marry signed documents from both of us was sent in with original I-209F packet to begin with but for some reason they want it again. Go Figure?

Reading your post, we are in the similar sort of situation, will follow to keep updated, thanks for posting!

3 days is very reassuring. I'm sending my RFE back in about an hour. So it should arrive there by tomorrow (wednesday) which means if it follows your time frame, we should have an approval either the end of this week or early next week. The anticipation is killing me.

Hello All:

I had to read it three times over online and call the USCIS to confirm, but yesterday my fiancée and I were approved for our NOA2!!! Such an amazing, amazing feeling!!!

I hope the rest of the process goes smoothly until she is here in my arms! It only took 6 days after we submitted the RFE overnight to receive the NOA2. I am now waiting for the instructions and next steps to be sent to me via mail!

I am truly thankful and the process only taking 4 and half months considering at one point it was listed 7.5 months! I appreciate all the help I have received so far on this site. This site is such a wonderful asset to have during this difficult process being apart. I hope everyone receives wonderful news as well soon for those waiting still! Best wishes!!
