Timeline

A 66 year-old US naturalized citizen (divorced, retired, own home with no mortgage, living on a monthly $1,000 social security & medicare) wants to petition for a K-1 Fiance visa (48 year-old lady). I have not filed taxes since 2004 due to a fatal auto accident that resulted in the loss of 2 children, then caring for a quadriplegic ex-wife & traumatic brain injured daughter (now 17 years old).

I have an engineering professional license, doctor's degree & have taught in several universities for many years without any retirement benefits. Most likely, I will teach at local university as an adjunct professor upon their arrival. The foreign fiance & her 19 year-old step-daughter will be working in the US after adjustment of status to help with family expenses.

1. Are there a concern about the K1 visa approval?

2. Do I need a co-sponsor (my 42 year-old son from my first marriage or a brother)?

3. Did any one have similar experience? ideas? feedback? issues of concern? etc...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sorry for your terrible losses in family. 2004 was years ago and you were of working age. Contact the IRS about no return/filing. Thats a leap forward to answer Question #1. If money appears and No taxes paid thats a concern.

Yes, you will need a Co-Sonsor based upon your post.

Now, after years you desire to work. Pay for teaching is Taxable.

Is your question more towards: I evaded and now wish to Petition and it's coming back to haunt me now ?

What is the value of the home that you owe?

If it is 5 times the difference between 125% of the federal poverty threshold for your household size (including your fiance and her daughter) and your household income then you will meet the requirements and do not need a co-sponsor.

I receive my deceased spouse's disability plus I am self-employed (so I pay taxes every year). My combined income (SS plus self-employment) is above the required amount for my family of 2, but the embassy still required a co-sponsor because they considered my income unstable. Proof of income, filing tax returns...all very important. Not only do they look for proof of a bonafide relationship, but also proof the immigrant(s) will not become a public charge.

CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

Note: Know it all... I have'nt filed Taxes since 2004. Everyone knows the home counts and is an Asset. Read carefully the OP's post. (how old would the OP be in 2004) ? I think he fell in love and now needs a quick fix for the past. $1,000.00 a month... HELP

I am having a very hard time understanding what you are saying here. What does his age in 2004 have to do with anything? And why are you assuming the reasons for falling in love, much less does it matter?

My question was simple. If his home can be used as an asset, then does he or doesn't he need a co-sponsor on his I-134F?

It's my understanding based on many posts here, that real estate (a home) cannot count as assets unless it is a SECOND home that you can readily sell for cash. Your own home that you live in cannot be converted to cash without putting you out on the street and/or forcing you to rent, so it does NOT count as an asset for these forms.

I could be wrong, but dozens of posts on the forums here, as well as common sense when considering what is a "liquid asset" (as stated in the form instructions), lead me to think that the house does not count.

K-1 Visa: I-129F filed November 6, 2012, NOA2 May 17, 2013, Interview and Approval July 24, 2013

POE San Diego, September 13, 2013, Wedding October 25, 2013

AOS filed November 19, 2013, EAD/AP received January 30, 2014, interview and AOS Approval on February 27, 2014.

ROC filed December 3, 2015, NOA1 12/4/15, Biometrics 12/31/15, ROC Approval on June 16, 2016, 10-Year Green Card received June 22, 2016.

N400 filed September 14, 2023, same day acceptance and Biometric Reuse notice, Interview on 2/13/24: Passed and same day oath. ALL DONE WITH USCIS.

Could you live on $1,000.00 a month. Are you required to file a tax return ? Thats the question.

One thing to look into is #1 and does your embassy accept co-sponsors. many do not. So I would check that for sure.

You do need a co-sponsor for sure.

And I am so so sorry for your losses. God bless you that your heart was still open to new long. Happy blessed journey.

Not necessarily. Assets need to be liquid or easily turned liquid without undue hardship. Selling the family home you all live in would definitely be a hardship and then mean they would be homeless. A single home that you reside in may not be considered because of this reason.

The OP needs a co-sponsor. If their consulate does not accept co-sponsors, then they need to look into getting married and filing for a spousal visa since a joint sponsor can be used in that case for the I-864.

First i´m going to the tell you a little about our story...

we met 6 years ago in Mexico. we have a child (he´s 2 years old) and we are doing all this process because we want to live in USA together. I am a USC.

Well my question is..

my fiance and i have the interview in about 2 weeks in Juarez, Mex... but i´m full time student so i got a co sponsor (my uncle, his USC) we have all the documentation of my uncle (from his bank, his property , housing, his job) and he qualifies (economically) to sustain my fiance, our son and me, and all his family.

so, i need your opinion and experiences about CO SPONSORS. Some people say that some consul do not accept co sponsors and others say in JUAREZ consuls accept co sponsors..!

I'm confused!! please help me!!

Juarez accepts co-sponsors. You, the primary sponsor/petitioner must also provide an I-134 and supporting documents.
