There is no specific mention of this scenario anywhere. Wondering if an InfoPass appointment can help?

I read you can do AOS if in a legal status inside US.

08/05/2013 (day 1) - Delivered to USCIS Chicago
08/08/2013 (day 4 ) - Received USCIS Acceptance Confirmation emails. Awaiting official receipt notice (Form I-797) in the mail.
08/08/2013 (day 4 ) - Check cashed
08/12/2013 (day 8) - Received 3 NOA's by mail (I-485, I-131, I-765)
08/16/2013 (day 12 ) - NOA for Biometrics appointement. Date set for 08/27/2013

I had had an approved I-130 before my priority date was current...but the rule says you can file an I485 with a pending I-130 receipt when your date is current. You can find out anyway.

Thanks..!

This basically benefits those whove had their i-130s approved, and gotten the case number from the NVC and thus have their process started. The only reason they did this as mentioned is because there are not many people in the line right now.

So if anyone goes and marries today and applies, technically they are eligible for a visa but they have to go through the long i-130 approval first so this doesn't mean anything special for those people unfortunately.

My PD is April 03, 2012 so I've waited quiet a long time and I just got the case number yesterday from the NVC! smile.png

is this mean we, f2a category treated like spouse of USC? no need to wait priority to be current?

and what is I-485? my case is in nvc already, waiting to be case completed. should I apply for this I-485 too? pls info. thanks.

I-485 is only for those adjusting status in the US. It is not for those who will undergo consular processing.

F2A will not be current forever. It will be current in the coming months as very few have completed their cases at NVC. Majority has just been approved by USCIS and will still go thru NVC.

aaah ic... I thought we are now treated like spouse of USC with no PD.

so basically once our case is completed in NVC we can get I/L at anytime, no need to wait to be current again rite? since VB august is current for all f2a category. thanks apple21,

and how about AOS, do we necessary to apply that once we got our GC?
