Hi all,

My husband (from Mexico) and I (US Citizen) have our interview coming up on December 6th. I feel very prepared but any other ideas would help. We have pictures, documents, letters with both of our names, bills with both of our names, and our 2 year old son. We have been married for over 3 years now. The only problem is that my husband came here undocumented. We know that we have a huge chance of being denied and then have to file for the I601 waiver. Do you think there is any chance to get approved?

Also, we were able to get a letter of support of a local Senator ... do you think this will help?

Your evidence of your relationship sounds very strong. But if he was in the US for more than 180 days illegally, he will be definitely denied at the interview - no question about it because that's the law.

Barring any other ineligibilities, he will then be given a second appointment to return to CDJ to file the waiver, pay the fees, submit his fingerprints and turn in your hardship letter. A letter of support from a senator won't hurt, but it's the letter and evidence in support of the claims that determines whether or not he will ultimately be approved. Waiver wait times in CDJ are currently nine months - are you aware that during that time he cannot return to the US? Examples of hardship letters and guidelines can be found on immigrate2us.net. Yeah at least we knew that he may have to stay down there. We already have plans for each situation so that I am not left stranded with my 2 year old. It sucks because I may have to pick up a second job to pick up the loss of an income while my husband is in Mexico. I may send my son down with him so that I can just work and take care of my family. Does anyone know why the wait times are so long? too bad you can't just pay a fine like before. I would come up with all the money I could if had to!!

CDJ is said to be the second busiest consulate in the world. They receive more than 5000 waivers per month. They have three people processing waivers (although word is they have hired more).

I guess I can olnly hope that more people will help move along the wait times. I heard that the only way to expedite a waiver is for a medical emergency... what is considered a medical emergency?

CDJ almost never expedites a case. They will only consider it if the USC has an "extreme medical condition or emergency" or is being deployed. By not defining it, they can more easily deny an expedite request, I assume.

you say your fiance came here undocumented. Was there any documentation that he was here? Did he return on his own? Or was he deported? I think maybe those things might matter...????

September 11, 2006 NOA1 received in snail mail

September 12, 2006 Touched (most likely to add Receipt Number to system)

September 13, 2006 Touched

September 14, 2006 Touched AGAIN!!! (what's up with this?)

Novemberr 13, 2006 NOA2 (77 DAYS!) YEEEE HAAAAA!!!!

December 6, 2006 Received Notice that everything was sent to Juarez

January 26, 2007 Juarez sends out packet

February 3, 2007 received packet from Juarez

February 6, 2007 going to medical & interview in Juarez!

February 6, 2007 RECEIVED VISA!!!

February 9, 2007 FLIGHT TO US!!!

We origianally filed the I130. I see the K1 and K3 visas everywhere but I don't know what those are. I am getting my hardship letter together but having a hard time. My husband came over 9 years ago. He has never been deported. He has done his taxes. Has Paystubs. So he is documented in that way. Never been arrested... no trouble at all. I wish there was some way we could show he is on the up and up. My parents are heading down there as well. We read in one experience that it helped someone else to have their In laws there. My parents are very fond of my husband and want to help in any way. I am trying to do anything I can in my power. Who knows if any of it will work.
