I am a Canadian citizen. I am currently living in the U.S on my own F-1 student visa. I live with my fiance, we've been together for a while, he's the whole reason I decided to go to grad school and I obviously attend the same institution as him.

So, as we fill out the I-129 papers, we see that these expect that I (the non-citizen) am living in my origin country, Canada isn't incredibly far from where we live, but my "Canadian address" (my parent's home) is kinda far and that's the consulate office I think I have to apply through.

So with my/our situation, what is the deal? Do I have to return to Canada for any part of the process? Am I eligible to file the form to change visas?

Moved from K-1 forums to adjustment of status forums as the OP should not be filing for a visa but should be getting married and filing adjustment of status inside the country.

The I-129 is used to petition for a fiance visa, which permits fiances living outside of the U.S. to enter the U.S. to marry. It is not used for aliens who are already living in the U.S.

If you would like to become a permanent resident of the U.S., you should apply to adjust status after you marry. This involves the I-130 and I-485 and assorted other forms and can be done from inside the U.S. As a fiance who is already living in the U.S., you are not eligible for any change until after you marry.

whoops. discard the I-129F - you've the wrong form.

When you have a moment, come back to VJ on a PC and study the guides section - there's a guide in there for you.. You not chase a visa, based on 'the basis' for getting a green card, at all.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
