Regarding AOS I 864A...

Timeline

So this is the scenario...

I'm single and living with my younger brother who's now married with 1 child. I have petitioned both my parents and now preparing for the AOS forms since we were instructed to pay for the AOS bill. From the instructions given for I 864, I need to file separately for each petition. If only for one parent, the Minimum Income Requirement in the 2013 Poverty Guidelines will suffice my own Current Annual Income but for both I don't think it will. Now in the instructions it says that a household member current Annual Income can be use when a sponsor's income and assets do not meet the income requirements. In this case, I'm looking at using my brother's Annual Income to cover up for the other parent in which I will file an I 864A (Household Member contract with the Sponsor.)

Now my question is:

1. Can I really use my brother's Annual Income since I'm planning to move out of the house before my parents entry to the US and will stay with my parents in an apartment for awhile until we get our own house?

2. Is there an Annual Income Requirement for a Household Member since my brother's annual income is a little less than mine considering now that he has a wife & a child though his wife is also working?
