I haven't receive that yet. You can call uscis if your PD is current. I do not care the financial sponsor, we will ask someone else to do it. If you are working here, and the visa still available at the time you have the interview, you can use the I485. It doesn't matter whether your applicant is green card or citizen.

I made a big mistake... Sorry for that. I want to ask whether he should file I485 or back to China to have the interview. Which way would be faster. Sorry for the mistake.

Your husband's PD must be current before he can file an I-485 to adjust. He must also be in the US legally on the day he files.

He must return to China if he cannot legally stay in the US until his PD becomes current.

(PDs becomes current in the 1st of the month. It's not effective on the date released.)

Hi aaron, do you know whether we can file i-485 when PD becomes current but case hasn't been approved? Given the beneficiary is holding the legal status in US when PD is current. Thanks
