not getting along anymore before 2 years card expires

hi, i got married to my wife in nov 2011, got my 2 year Card in may 2012 we lived together for a year then things didn't workout, we were fighting all the time, we were not compatible financially, now we don't live together anymore, did our taxes separately (she didn't want to help me on this ), thinking about divorce, she met somebody else, me too,and i don't know what to do now, i have to file to get conditions removed and my card expires in 5/31/2014, i would really appreciate any thoughts or advice on this situation,

Get a divorce and file for ROC with a waiver. Being divorced is OK. The ROC is not a test to see if you and your wife are still in love. What is important is that the marriage was not fake in the beginning. You should have nothing to worry about.

Get the divorce done first. After that file I-751 form with a waiver

Part 2: Basis for Petition -> Waiver Request Filing -> 1.d. I or my parent entered the marriage in good faith but the marriage was

terminated through divorce or annulment.

Gather proof to show that your marriage was entered in good faith -

e.g. joint medical and car insurance, joint bills, a joint lease or mortgage, joint loans, etc.

Then send them in together with I-751 form and a copy of your divorce decree.

Gather all your immigration documents, any evidence of a real relationship, file for divorce and file when elgible for ROC. Good Luck. Many have done thier own in your situatiion, although an attorney is an option. Wishing you Good Luck in a bad situation. Filing Date Calculator

It could for ROC because your marriage ended quickly and you found someone else so quickly.

Don't marry until your ROC is complete to be safest so you don't raise more questions about the validity of the marriage you got your GC through.

After ROC though, you should be fine.

I would wait until the ROC is complete to remarry. I have no idea how to explain that you are no longer divorced. They might think you used your 1st spouse to get a green card and now you're moving on to your real life. I've read that if you get divorced during your ROC, you need to resubmit paperwork. I'm not sure how it works if you file a divorce waiver and then get married during the ROC. Just be careful.
