I have an interview at the local USCIS office , but do not have a copy of my divorce from over thirty years ago. I have called and written to the California county clerks office, but they say they have no record of this divorce. I know I went to court for the divorce, but can't remember exactly when or who my lawyer was. I have since remarried to an Dominican woman and have been married for almost 5 years. I do not even know if my last wife is alive or deceased. I have searched on the internet and can find no record of her. My daughter in California has not seen her for more than 6 years and had said that she remarried at least two times after me.....What to do?

Oh and by the way, The California county clerk told the my divorce was around the time that they were switching over from paper to computer records and she said that a number of divorces were "lost". But of course when I called to get a letter stating that, she said she never said it!! CYA I did have a copy, but is was destroyed in the 1989 earthquake...I never figured that I would need a copy, since in the US you don't need divorce papers to remarry.

Says you have to go to the superior court in the county where the divorce took place to get the actual divorce record. I'm assuming that's who you talked to?

If you can't get it, I suggest making another infopass and inquiring about what you need to do since the record would be unobtainable.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Wow, are you going to give up? Ever think about a very well qualified immigration attorney? Unlike other attorneys, since this is federal can be one from any state.

Gosh I was angry after my divorce, soon as I got home pitched the entire file in my trashcan, but fortunately, garbage pick up was not for several days, cooled down, grabbed that file and stored it away. Then met that very special person eight years later. Needed all that.

One piece of paper I needed was a birth certificate where the state of Illinios had that and also transferred all the records to a database. Hiring a bunch of people that couldn't even type. What a mess, birth certificate was sent loaded with typos. Went to the very top, send all kinds of evidence, military records. etc. and after three months, they finally got it right. Never settle at the bottom of the ladder, go to the top.

Same problem with the VA, am a veteran of a foreign war and entiled to some benefits. VA in St. Louis had some kind of fire, so all my records were burnt. But fortunately, did save all of my original records, so am getting some benefits. But have to show my DD-214 each time. Asked my VA office if they could put me back in the system, dey don't do dat kind of response.

Did hear about a special VA discount when buying a new vehicle. Went to my dealer showing my VA card, but wasn't in the system which I knew I was not. So got another, we can't do dat. But the dealer said he would give me a much better deal if I paid cash, so I paid cash.

Did hire an attorney for guidance with flat fee, gave me a list that I forwarded to my wife to be, Told her to make sure she hand carried that stack of paper work, luggage does get lost. She did that. With my wife's US citizenship interview, didn't want a darn thing to do with me, but sure wanted to see my papers. Not that they already had all those already. And they wanted to see all the originals, but that time, I did find my original birth certificate so my wife showed that. Was jammed in that four inch pile of all my original military records. So I did have it all that time.

Hopefully with you, with no alimony charges against you, and a notarized statement from your court house, they were sloppy and lost your records. In our history with the USCIS, they lost copies of our records, not once, but three times? Hopefully they will overlook this.

With our register of deeds, would make copies of any important documents and provide you with a certified copy that was just as good as the orignal. But they don't do that anymore, something about being overpaid and under worked. I know of no means of getting certified copies of anything in this country, Sure looked, but so far came up with zero.

I did purchase a file proof filing cabinet.

Well, I have filed for divorce from wife whom I married in 1982 and thought I divorced in 1987. I am just wondering if I have to divorce my Dominican wife (married in 2008) since the US doesn't recognize the marriage. I have withdrawn my I 130 petition because if I don't it will be denied on the grounds of bigamy. This is crazy. On one hand I am a bigamist, but on the other hand the US doesn't recognize my 2008 marriage. I guess I will just divorce everybody and then remarry my Dominican wife when everything is final...Hopefully getting divorced from everybody will satisfy the USCIS.....

I found the wife I thought I divorced in 1987 living in California. She had also remarried. Since I live here in Florida, I have to file for divorce here. Rather than screwing around with this last wife (the one I married in 1982), let's just divorce everybody and start from scratch...

Hope you don't get stuck with alimony again. This is your only solution? Go through that same divorce again!
