Hi everyone,

Have probably stupid question

Im getting married to US citizen in couple of months, my parents and sister in law want to go to the wedding in the US. My sister in law is pregnant and she is wondering if us embassy will issue her a tourist visa. By the time she will apply for visa her pregnancy will show. Does embassy officer can deny her visa because of that?

She will not know unless she applies. They do not have to give the reason for denial.

Maybe she should apply before pregnancy shows?

I would say everything will hinge more on her ties to Poland than on anything else.

"Although there are no specific regulations prohibiting pregnant foreign nationals from entering the U.S., entry is allowed or denied at the discretion of the admitting U.S. Customs and Border Protection (CBP) Officer. If the CBP Officer determines that you are likely to become a ward of the government (meaning that the government must provide medical care because you do not have medical coverage), you can be denied entry. When determining if you will be allowed to enter the U.S., CBP Officers take into consideration the date your child is due for delivery and the length of time you intend to stay in the U.S. In addition, they want evidence that you have sufficient medical insurance to cover any medical necessities while you are in the U.S. and that you intend to return home. If it is determined that you do not have sufficient medical insurance to cover any unexpected or expected medical care while in the U.S., you can be denied entry. Additionally, if you are pregnant and entering the U.S. at a border port of entry via vehicle, be aware the radiation detection portals deployed at the ports do not emit any radiation, and do not present a hazard to you and your unborn child." Also I would advise against trying to conceal the pregnancy in any way.

Wow, thanks for that info, her date for delivery baby is for december, so since wedding is planned for september then there shouldnt be a problem for her to enter the US

She will likely have lots of problems entering US with visible pregancy. Ever heard about anchor babies ? People come to have child born which at this point is a US citizen. I will seriously re-think this as it may not be fun for her if she is immediately sent back.

I see, but if she would have insurance for pregnant woman (i know there is special insurance for pregnant woman) she can still have problem entering the US? That time she will be 28-29 weeks pregnant, and the insurance covers for woman up to 32 week pregnant. Beside, she will have return ticket, and will come to the US for only one week, no more than 8 days. Plus from the beggining she didnt have problems with her pregnancy and she said she can have statement from her doctor that there was no problems during pregnancy and that she can travel.

I would say everything will hinge more on her ties to Poland than on anything else.

She can apply early but she can be refused entry at POE as well.

Visa does not guranteed an entry into the country.

Cost and medical issues are later issue - lot of tourist change their mind as soon as they hit the US soil and stay for the duration of preg to give birth in US.

I would not recommend her traveling this time, it would be much more issue if she is refused entry at POE and she will have to fly back home on the next available flight.

Its not fair that they treat everyone same way, if someone tells truth is still considered as potential immigrant

They should start using machine that detects if someone lie or tells the truth, one question: are you planning to stay illegal in the US and everything would be clear. I hate gov and their rules

Or she could stay here, give birth to the baby who will be an American citizen, then try to immigrate using that as a reason.

I agree 100% that it's unfair to be a victim of a stereotype but tbh, I don't think the govt is to blame. After all, if it has happened to you thousands of times in the past, won't you take precautions to prevent it from happening in the future?

Even with a wedding invitation and a return ticket, it's not always considered as strong proof by the consul. Maybe she could include birth documentations like a medical certificate or hospital reservations (I've never been pregnant so I don't know if these things actually exist) for the birth of the baby. Only way to know for sure is to try.

Airlines might not let her board being so close to delivery. Even if they might let her fly going into the US, by the time flying out comes it would not be possible. CBP might decide that is sufficient reason to deny entry and have her in the returning flight.

I would start by checking with arlines if a flight is even possible before dealing with visa

Sorry is not so good news, but would save a lot of problems later.
