This is a question for my sister. Her K1 petition is still pending here in the US - it has never been to the NVC processing center yet. However, I would like to get my mom to visit me and wife in the state, but my mom doesn't want to come alone she's afraid. So I would like to ask my sister to accompany her.

Would there be any red flags or any complications about this? Please advice.

I am not expert, but usually when someone has a pending petition with immigration they give them a hard time to get a tourist visa. The reason it's mostly because they want to make sure you have no reason to stay in the US, and with a pending K1 process well, it is hard to prove that is not her intention since that is the main purpose of the K1. I really hope this is not the case for your sister (if she tries) and then again this is just my opinion. Also, i don't know if all embassies have the same rules.

She has a fiance and sister in the USA, and her mother will also be in America at the time. It sounds like she has more ties to the USA than to home. Not impossible, but very difficult to get a tourist visa under these circumstances.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Does the form ask about this? I thought it asks about immigrant petition but my sister's case is K1 visa. The petition has not been finalized yet, will the embassy find out? As in, is her name in the system? Or how do they even ask the question about her fiance. I am not trying to get away with the law, but my mom would not come unless accompanied by my sister. So not sure what to do here. She's never been through interview before either.

when you apply for a visior visa they will ask if you have any pending cases

there is no reason to try and conceal or hide any information at this stage it will only bite you on the you know what later

It doesn't matter which US agency currently has your sister'sK-1 petition. She will need to disclose it in the B2 visitor visa application. The US Embassy will know about it.

If your sister can't get a visitor visa and your mom refuses to go without your sister, your mom can always wait for your sister to get her K-1 and apply for a visitor visa at the same time. Then your mom can come on a visitor visa and your sister can come on the K-1 visa to visit you in the US.

I have a friend who has a pending petition via her dad and she was able to get a 10 year multiple entry visa just a few months ago. It's not impossible but she will be asked if she has any immediate relatives in the US and her travel companions so the consul might see those as red flags.
