Filing through Spouse

Hello there,

I am about to file for my greencard through marraige. I have completed all forms and ready to send it to the USCIS. There is a slight confusion, which i hope to solve through this forum. I was a graduate student. Last year i didn't extend my I-20 and as result i had to reinstate my F1 status. I sent all the documents including my original I-94. The reinstatement is still in process. The process is still in its initial review. I cannot wait more since it has been more than 8 months. Thus, I married my girlfriend last April, who is a US citizen. Now, I am ready to file for the greencard through my spouse and I don't have my original I-94. Will the departure and arrival stamp in the passport be suffice or do I need to do something else in this case?

You can use the arrival stamp but it is up to you to prove that you did not leave since then. It can be slightly tricky. You can also file for a replacement I-94.

A copy of the I-94 may suffice. And a note in your cover letter that you submitted the original with your F-1 reinstatement application.
