I'm a naturalized US citizen, (May 5th of 2012) based on my marriage to a US citizen. Since then I filed for divorce (Nov, 7th 2012) and went back to my birth country, India. My question is my divorced was granted 7th of Dec 2012 and in India, I got married again on the 8th of Dec, a day after I was granted a divorce in USA I got married in India.

Now that I'm back in USA can I file for my wife of Indian origin.? Is there a grace period between divorce and re-marry when it comes to immigration.? I don't think I broke any laws of either countries but I'm not sure. The next question is what if I file K1 for her to get here and get married in USA .? I'm helpless at this point and I don't know what to do.. Please help.!!

You have broken no laws.

However, this looks like a classic case of Mary a US citizen, get a green card, get US citizenship, divorce US citizen, and then go home and marry girlfriend.

There is a provision for cases like yours. Read the instructions for form I-130. The immigration petition you file for your wife will receive extra scrutiny. You also need to prove your first marriage was bona-fide and not a immigration scam.

I'm on the same level here with the other posters. Going back to India and marrying your girlfriend one day after your divorce is is finalized, is a casebook immigration scam. Even if your intentions were true, you will probaly face a hard time with USCIS.

It's amazing how many questions can be resolved with a 2 minute Google search...
