Green card expiring in 2 weeks

Hi all,

My conditional green card will expire in 2 weeks. My husband and I are trying to gather evidence of bona fide marriage and will be sending I-751 package out within the next week or so. My questions are:

1) if we send the package with priority mail, how long does it take for the USCIS to receive the package and acknowledge it?.

2) Let's say they receive the package 2 days after my green card expires. Will that be a problem?

3) is it an option to send the application first and send supporting documents at a later date?

I would really appreciate it if someone can answer the above question. I am really worried. Thank you very much in advance

1. I think ours took about a week. I would "splurge" and pay for overnight in this case.laughing.gif Time is not on your side.

2. Depends on how you feel being illegal. I don't think ICE will come looking for you, but it's never good to be out of status. I honestly don't know how that would affect your ROC. Do a search, I'm sure there are similar cases.

3. I wouldn't try that. The chance that the 2 mailings will somehow end up in the same case file is about 2%. Like most government jobs, CIS is comprised mosly of retards and rejects from real jobs. (I'm sure I offended some here who may be gov't employees; not intended. I said "mostly" not all; you are excluded from the mostly group.)

3) Not ideal. You'd have to send the form + payment, then wait for an RFE to mail in the supporting documents.

Why did you wait so long? You could have filed 2 months ago.

If you don't have your documents together now and can't get them sorted out in a day or so, *I* would send in the form + payment and whatever documents I had. At least you'll get an extension letter and be in status that way. Do not mail your supporting documents without the RFE notice or they will likely not be linked to your application.

1) Priority Mail delivery is 2-3 business days. Acknowledgment from USCIS (in the form of a NOA1) typically follows within 30 days of receipt. Since your expiration date is fast approaching, you may even want to consider Express Mail (guaranteed delivery in 1-2 business days).

2) In all likelihood you would be fine as long as your petition was postmarked prior to the card's expiration date. However, I wouldn't risk that happening and I'd try to get the petition received by USCIS before the card's expiration date. You never know and better be safe than sorry.

3) By sending no supporting documentation whatsoever you run the risk of having your application returned for lack of documentation with the instruction to refile. Being that close to your GC expiration date, you could easily find yourself out of status by the time the petition got returned, so I'd say send all you have as soon as possible to avoid the petition being returned, and just prepare for a possible RFE later down the line. Keep gathering all the documents you need even after filing so that you can be ready to respond to a potential RFE with as much solid evidence as possible.

Good luck! The priority now should be to send out that package as soon as possible with at least some supporting documents, even if it's not complete at this stage.

1. send it with usps priority next day, that's what i did, they received the next day, and when i received my noa1 it was dated the day they received the my package.

2. hmm could be i guess, but can't be sure, not sure if they can process if your green card is expired, you might need to file a waiver, but like i said not sure others?

3. never heard such thing, they may or may not send you an RFE for the supporting documents, but why risk it? coz if they don't even accept it then you won't get noa1 until resubmit with all the supporting docs

I sent the forms plus the check on March 23th, and the supporting documents about a week and a half later I think, after I received my NOA1.

My ROC was approved on May 24th, no RFE, no interview.

1) Do not send via USPS. I was late in filing, like yourself. My card expired on 22nd and I didn't mail it out till Sept 20th. Now, I went to my local ups/fedex store to overnight it, however they are unable to overnight to a PO box (mine was sent to CSC). I called USCIS and after about 45 mins they gave me the physical address so that it could be overnighted.

2) If the package is received late (after your expiry date) it will be a decline.

3) If you do not send all the supporting docs at the same time you will get a RFE for sure. I would hurry up and gather all your paperwork and overnight it.
