Tourist Visa AP based on profession (science)

Hi Everyone,

My father-in-law (and by proxy, mother-in-law) were put in AP today at the interview in Kiev(Kyiv) because of his profession: biochemistry professor/researcher.

After reading up on it, it seems like a pretty common thing, but I was just wondering if anyone has any more input.

Please see this link for the detailed post and the attachments, 221(g), that the embassy has requested to fill out.

For anyone who doesn't want to go read the link or look there the summary is this:

- They were told to leave the passports at the embassy, but couldn't, since both of them are traveling to Germany in 2 weeks (I take it as a good sign that embassy staff wanted the passports)

- They were given a questionnaire to fill out that looks like the one you do when you apply for a science visa, so I just advised them to fill out "Not Applicable" in the fields that do not pertain to their tourist visa application

Any sort of advice or insight would be welcome.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Anyone who works in science, chemistry, etc is going to have extra scrutiny when coming to this country because of the bioterrorism threats. I think it's probably pretty normal for administrative processing given the field of employment of your father in law. But a good sign that they were able to leave with their passports to go to Germany in a couple weeks. It really just sounds like they're going to run them through extra checks before approving.

Yeah, that's what I've been thinking. Kinda dumb move to go to the US embassy for a visa when you have a trip to Europe in 2 weeks, but, heh, what can I do...

There is nothing wrong about applying for US visa when they were planing a trip to Europe, just go ahead and provide the additional information and once AP is complete Consulate will request for the passport if visa is approved.

May have missed it.

Actually I'm kicking myself for not researching this... apparently when an applicant fits a certain profile (certain professions) it's an automatic AP for the first visa...

They got the following reply from the embassy:

Thank you for providing your CV. We would appreciate it if you could also send us your U.S. Invitation Letter (can be an email from your relatives). We need this document for administrative processing of your case.

So it seems like things are moving along. My wife and I will write up a letter (even though this says it can even be an e-mail) and hopefully their AP will be over soon(ish...)

If anyone can chime in, please, what do you think I should include in the letter of invitation that the embassy is asking for?

It's for my in-laws, so I think my wife should be the one writing it. Should I include a copy of her GC? Copy of my US passport? I'm not sure what exactly they are looking for (I mean they asked for a simple e-mail even....).

Any help would be appreciated.

If I was in you place I would just write a letter about what they will be doing and what is the plan like meet family, touristy things etc.

I would not include the copy of GC or passport, that is already mentioned in the DS-160 as well as consulate really does not need these things.

At this point I'm not exactly sure what they want... I mean if they take a look at my wife, they'll find ME anyway, and all the information about me, so I don't even know if I should bring myself (USC) into this whole mess.

In any case, do you think this letter is sufficient?

I would not include anything like that in the invitation letter, those thing are not in your power and you cannot enforce it but I would put like where the else the vacation is planned if any dates if you can.

Other than that just leave it very simple invitation letter.

Since they sent the e-mail to my in-laws, requesting the invitation letter, do you think I should sign, scan and

1. Send it to in-laws and have them forward it to the embassy

2. Send it to the embassy ourselves (from US)

3. Have in-laws send it and have us send it as well.

I'm leaning towards #1...
