Hi guys.

I know it has been posted many times but I have been so busy and behind w the topics here in VJ.

I would like to know some information regarding the petition for stepdaughter. Is it called I-r2 petition? My husband might end up petitioning my daughter as his stepdaughter. How much the fee, the requirements, and how long it takes? Lastly, does my daughter needs to apply for AOS when she gets here?

Hi, it shouldn't be a problem as long as the marriage occured before your daughter's 18th birthday. Your husband needs to file an I-130 form. It cost $420 and he will need to send a copy of the marriage certificate, his birth certificate (Proof of US citizenship), your daughter's birth certificate, and copies of any divorce/annulment documents. It can take anywhere from 6-8 months depending on the service center processing the petition.

There is no need to apply for AOS since your daughter will get her temporary green card stamp in her passport upon arrival to the US. The actual green card will arrive in a few weeks.

I see that you were married less than two years. Is that correct?

If so, then the visa classification would be CR-2 rather than IR-2. CR is the conditional resident, while IR is immediate relative.

It would be best for your husband (the USC) to petition your daughter. BTW, how old is your daughter? How old was she when you were married? Have you ever been married to your daughter's father?

Your husband would file the I-130 petition, as she would be considered his child. Current filing fee is: $420. The petition takes up to 6 months to be approved. After approval it is sent to NVC for further processing. I highly recommend reading this guide. If outlines the basic steps during USCIS, NVC and US Consulate stages. Please, please, please be proactive during the latter stages (especially NVC). It will drastically reduce the processing times.

Once your daughter is admitted to the United States, she will arrive here as an immigrant. Her permanent resident card (green card) will arrive in your mail within 3-4 weeks (usually). There will be no need to AOS anymore.

Hi huys thanks for all the replies. I appreciated. Markieboy I do not get it? So it's not I-r2? My husband petitioned me as his fiance back then. And we have been married for 9 months now. My daughter is 5 years old. She'll be six on August.

No, if you and your husband are married less than 2 years, the visa classification would be CR.

If you both are married more than 2 years, then the visa classification would be IR.

For example, I was married to my wife less than 2 years. We applied for her AOS. Her green card had CR-6 on it.

But when I petitioned my stepdaughter, my wife and I were married almost 3 years. My stepdaughter's green card had IR-2 on it.

It's just the visa classification. It really doesn't affect the permanent residence status...only that you must remove conditions later on. biggrin.png
