interview in Canada or Philippines?

Timeline

in the I-129F petition sent by my USC fiance, we requested that the interview be held here in Vancouver, Canada.

...but i am not a citizen or a resident here..i just have a work permit valid till May '07... i am a filipino citizen.

i am allowed to stay here in canada until MAY'07 having a work permit....can my interview be held here in vancouver? or will i be sent back to the philippines (my home country) for the interview?

You should be fine with the interview being in Vancouver, as long as when you filled out the forms for the initial petition, you listed your current address as the one you are at in Canada AND that your interview happens by May '07.

edited to add: Just remember that you will need police certs from everywhere you have lived for 6 months or more since the age of 16.

Jul 5 - Receipt date for I-130 petition for my over 21 brother and his wife (both in the UK)

2024

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Aug ?? - mailed I-130 packages for both mother and father
Sept 10 - NOA1 date
Sept 16 - NOA1s received

2014

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

The Consulate in Vancouver processes fiancé(e) cases for citizens of Canada, or aliens who are permanent residents. Individuals in Canada on student and/or employment authorization are considered on a case-by-case basis.

So it appears that it is up to the consulate to decide whether they will accept and process your case. A consulate is not required or mandated to accept a non-resident case.

If you are currently legally residing in a country, you can do your interview in that country. My fiance is working in Korea and she's Filipina. Her interview is in Seoul in less than two weeks. This was never an issue, nor did we have to do any extra requests. We just indicated we wanted her papers to be forwarded for an interview in Seoul.

From my case, NVC assigns embassy by your current address not by your request of the choice. If you put your current address as Vancouver in I-129F, you will be assigned to an embassy in Vancouver.

My fiance was working in China when we applied and asked to have the interview in Seoul, which is her home country, but they assigned our case to China. When we asked NVC why they assigned our case to China, they said they only go by the address of the beneficiary and assign the embassy nearest to that address regardless of the citizenship and the request in I-129F.
