we do not know when they obtained their visa's, but it does make it so much more difficult for others when there are such blatant abusers like this.

I am sure they don't care about others behind them, as long as they are able to get what they want.

To answer your question, since you have already submitted the I-130 for the children you need to check the visa bulletin http://travel.state.gov/visa/bulletin/bulletin_1360.html to see when their priority date becomes current. Right now there is about an 18 month wait for a visa number. When the visa number is about to be current the children will have to leave the US and return to the country you listed on the I-130. There they will have a medical exam, obtain police clearances, as applicable, fill out paperwork and submit it to the embassy. They will then have an interview to determine if they will be granted an immigrant visa. If they are granted an immigrant visa, then they can legally come to the US and live. They must remain unmarried the entire time and they must return to the country you listed for processing.

really? i thought the big jump was AFTER the NVC Doc intake was completed and an interview date set,

and NOT after the I-130 was approved.

such a cold person, oh well hope you could feel what I dealing with. My child a kid with special needs, she had 3 surgeries in 2 moths of period, she can't move, she wont be able make it back, due to her surgery did not go how we all planed. This is very mean of you to judge, I hope you could feel my pain what I am feeling now. Karma is a good thing.

Immigration will have the exact same question that I did. And then you'll find out what cold really is.

What you did is risk your kids' future in the US as well as your own.

Persoanlly, since you committed visa fraud, I hope you get deported and get banned for life. They need to make an example of people like you so that others don't try to do it and maybe our legal relatives can get here quicker.

Well, i was allowing time for the medical and all that, they can leave the country whenever, the point is they will have to leave at some point to apply for the visa.

Certainly as far as the Medical side is concerned, Travel Insurance provides both medical coverage and emergency repatriation costs.

Usually Insurers will want to repatriate, Air Ambulance etc, asap to avoid the high costs of US Hospital charges. Not sure what happened here?

I just hope she has paid for all the medical expenses. Didn't apply for any government assistant program. Right? What is the child future? Would we have as a society have to pay for the child's long term care expenses? Would you pay? I would choose not to if I have a choice! I hate mothers like this!

This really interests me, too. The IO must have seen that she has dependant children, that will not go home after 6 months. Probaly hit a soft spot with the IO (we are all human...)

Anyway, the OP really is in a dreadfull situation. Wait here, risking her green card and her children status - go home, stay there for more then a year and loos her green card.

OP, I would really look for a good immigration laywer in your case...

It's amazing how many questions can be resolved with a 2 minute Google search...

My guess is she came with the children on a tourist visa to "visit" and the son filed for her green card while she was here. Now she has created a dilemma for herself by filing the I-130s for her children not realizing they can't adjust when they are out of status. She has two choices, have the children leave the country and process the green cards when the priority date comes up or fail to continue with the current I-130s and refile as she becomes a citizen. If she waits until she is close to citizenship the oldest child will not fall in the immediate family category, will have a ban, and will no be able to adjust status from within the US.

In the meantime she is risking her green card by having her out of status children here. She doesn't seem to realize this is jeopardizing her status.
