Hi!

My husband and I got married here in the Philippines last April this year. While I am processing other requirements here in the Philippines, he is trying to find a better job in the US. When he finally passed an interview for a good company, HR told him yesterday that he is on a red flag because he has a felony case that wasn't cleared up yet.

He told me that state filed felony case against him because his former gf wants to jump out of the car that he is driving and he keeps on pulling her away from the door so she wouldn't jump. There were people who saw the incident and thought that he was hurting his ex. His ex even said to the court that it was just a fight but my husband is not hurting her. But since Washington is strict, he was imprisoned for 2 weeks. And completed his probation for five years being a good citizen. The problem is he thought that after finishing 5 year probationary he thought that his record will be cleared automatically but it did not.

Our requirements are completed by now. I just want to ask if he can file it even if his record is still not clear or while on the process of clearing his record. My husband is a good man and there were juist ghost from the past that we need to get rid of.
