I-864 vs I-864EZ for IR-5 visa petition for parents

Hello,

Which is the right form to use, I-864 or I-864EZ form for petitioning my mom and dad?

Note that each has its own USCIS case # and NVC Case #.

Also, do you have a guide or a sample format for using the new I-864 forms (Form expiry date 3/31/15)?

Hello, I'm still confused whether to use the I-864EZ or the I-864 form.

I-864EZ instruction notes (page 1):

Who may NOT use the I-864EZ form:

1. You must complete I-864 (and not Form I-864EZ) if any of the following conditions apply:

a. The relative you are sponsoring is not the only person immigrating based upon the underlying visa petition...( Does this apply to my petition for both parents?)

I know for a fact there will be separate Affidavit of Support form for each parent so I'm wondering if I can use the I-864EZ form instead.

No if you are petitioning two people you have to use the I-864. The I-864EZ is for a single person petition, like a husband for a wife with no children accompanying.

But don't you think that the EZ form also applies to separate I-130 petitions?

I filed separate I-130 petition and each has his/her own MNL case number.

Thus, I'm petioning one person (one at a time), right? One petition for my mom and another petition for my dad?

i thought i might as well take a look at the instructions of I-864EZ which i did now.

it says you can only use this form IF ALL of the conditons apply:

1. You are the person who filed for I 130 for your relative

2. If the relative you are sponsoring is the only person listed on I 130.
3. If the income you're using is SOLELY based on your salary or pension.

so to answer your question you need to check if these 3 conditions apply to you. if only 1 or 2 applies to you, you cannot use this form.. hope i get to help you on this php smile.png btw, you also get to help me on this since i think I should be using one I 864EZ for one parent and I 864 + I 864A for another parent.

Imho you need to be using the I-864. Their cases will be together at the NVC so you will only be paying one AOS bill for two people. They should have their interviews same days too. But if you want to try, by all means try. Let us know how it goes.

Any idea, what do CMR and DMR stand for?

Just an update. They accepted the I-864 EZ forms that I filed. However, I will be receiving a checklist because I put in the wrong gross wage amount crying.gif
